1723 102 Att which said Next Court to witt the twentieth day of August ann Dom One thousand seven hundred and twenty three Comes again as well the Said Richard Holland by his attorney as the said adam Spence by their attorneys afd and the said Adam Spence by his said attorney Comes and Saith the afd Holland Condemnation of the premisses so as afd attached Ought not ot have because that he hath not nor at the time of the Laying the attachment afd in his hands had or at any time since hath had any goods Chattles rights or Creditts of the afd Edward Pladwell in his hands and this he is ready to verifie wherefor he prays Judgm.t if the afd Holland Condemnation of the premisses so as afd attached against him to have Ought &c Dasheill P Deft And the afd Richard by his attorney afd saith that he by any thing Prealledged by the said Adam Spence from haveing his action Condemnation of the premisses afd in the hands of the afd adam Spence Ought not to be precluded because he saith that the said Adam Spence at the time of Laying the attachm.t afd in his hands viz.t the Eighteenth day of august ann Dom One thousand seven hundred and twenty two at all hollows parish in the County afd within the Jurisdiction of this Court had in his hands of the Effects of the afd Edward Pleadwell to the value of Eleven pounds one shilling and six pence and four hundred pounds of tobacco and this he prays may be Inquired of by the County Allen P Querte and ye Deft Likewise Dasheill Deft Thereupon Command is given to the Sherr of Somersett County that Imediatly he Cause to Come here twelve &c by whom &c who neither &c to recognize &c because as well &c of Which Said preceipt the said Sherr to witt Joseph Macclester Gent now hereat ^this day^ to witt the twentieth day of august ann Dom One thousand seven hundred and twenty three makes return that he has here ready twelve &c as by his said preceipt he was Commanded and no whereafterwards to witt the same and year Comes as well the said plft as the said deft by their attorneys afd and the Jurors of that Jury Impannelled who being Called ^likewise^ Came to witt John Elzey, John Beavens, John Fleming Jonathan Raymond Charles Townsend John Caldwell John Billett, John Henderson Senr, John Turvell John Williams Robert Mitchell, Lazarus Maddux Poakamoak who being duly Elected tryed and Sworn to say the truth in the premisses upon their Oath do say that ^the said^ adam Spence Jun.r had in his hands of the rights and Creditts of the afd Edward Pleadwell at the time of the Laying of the attachm.t afd in his hands to the value of six pounds ten shillings &c Therefore it is Considered by the Justices here the twentieth day of August ann Dom One thousand Seven hundred and twenty three that three pounds three Shillings and Eight pence part of the Sume afd found by the Jurors afd be Condemned in the hands of the said Adam Spence Jun.r as of the rights and Creditts of the said Edward Pleadwell for the Use of the said Richard Holland and that the Said Richard Holland have thereof his Execution against the Said Adam Spence according to act of assembly and also it is Considered by the Justices here that the said Richard Holland the Recover against the said (671) Adam Spence the sume of six hundred & seventy one pounds of tobo by the Court here adjudged unto him for his Costs and Charges by him in this Behalfe Laid out and Expended & ye deft in Mercy &c
