                                           March Court 1717                                                9  
   prays that the Said Deft may give Special baile to the afd Accon which is granted
   and that he be kept in Safe Custody by the Sherf of Said County untill he Shall—
   give Special baile as afd..   After which Thomas Theakston and Nicho Waterman
   both of Said County here in Court cometh and Acknowledges themselves Joyntly
   and Severally Special baile in the afd Accõn and they and either of them do
   undertake for the afd Deft~ the payment of the Debt afd and Cost thereon—
   accruing if in case the afd plt~ Should obtaine Judgment on the Said Accõn
   of Debt and the Said Deft the Condemnation afd Shall not Satisfie nor—
   himselfe to the Custody of the Sherf. of Said County deliver or that they
   the afd Thomas Theakstone and Nicho Waterman or Either of them the—
   body of the Said George Waterman Shall not render &ca.
    And the Said Deft Saith that he Cannot gainsay the Accõn of him—
   the afd Plt~ nor but that the writing obligatory above mentioned is
   his Act and deed and that he oweth unto the afd Plt. as afd and is —
   willing that Judgment Should be entered for the Same and Cost thereon—
   accruing :   Therefore it is Considered by the Court here viz this Twentieth
   day of March Anno Domini one Thousand Seven hundred and —
   Seventeen That the afd Plt~ Thomas Jones do recover against the Said
   Deft~ George Warner as well the afd Sume of ffive Thousand pounds
   of Tobacco Debt afd as also the Sume of four hundred and Seventeen—
   pounds of Tobacco Cost by the afd Plt about~ his Sute in this behalfe
   Expended and by the Court here of his assent adjudged and the
   Said Deft~ in mercy ———

   Francis Collins | Commanded it was to the Sherf of Kent County the
                at | Twenty third day of November in the Second Year of~
   Francis Scott~— | Scott of Kent County Planter if he Should be found in


his bailywick and him safe keep So that he have
   his body before his Said Lord Ships Justices of the Peace for Said County to —
   Answer unto Ffrances Colings of a plea of Trespass of the Case And that~
   he have then and there the Said writ &ca. . Att which Said next Court viz the
   Eighteenth day of March the Same Year last~ mentioned the day of return
   of Said writ came Simon Wilmer Gent~. high Sherf of Said County and
   made return thereof in these words thereon Endorsed as folls viz Cepi Corpus
   pr Simon Wilmer Sherf. And a Decln being filed when Said writ Issued for[th]
   and a Copy thereof Served therewith according to Act~ of assembly in Such case
   made was as folls vizt. Maryland Kent County Ss Franas Scott. of Kent—
