   Thomas Jones | Commanded it was to the Sherf of Kent County the
             at | Twenty third day of March in the Second Year of his Lord

planter if he Should be found in his Bailywick and .
   him safe keep So that he have his body before his Said Lordships Justices of .
   the next Court to be held at our Court house in the Town of Chester in Said County
   to Answer unto Thomas Jones of a plea that he render him the Sume of five
   Thousand pounds of good Sound Merchantable leafe Tobacco of the value
   of fifty pounds Sterling money which from him he unjustly detains &ca
   and that he have then and there the Said writ &ca.    Att which Said
   next Court vizt. the Eighteenth day of March of Same Year last—
   mentioned the day of return of Said writ Came Simon Wilmer Gent~
   high Sherf. of Said County and made return thereof in these words thereon
   Endorsed as folls vizt. Cepi Corpus pr Simon Wilmer Sherf. . . And a Decln
   being filed when Said writ Issued forth and a Copy thereof Served therewith
   According to Act~ of Assembly in Such Case made was as folls vizt. Kent~.
   County Ss George Warner of Kent County Planter alis Dics George Warner of Kent County .
   Planter was Summd to Answer unto Thomas Jones of a plea that he render him the —
   Summe of five thousand pounds of good Sound Merchantable Leafe Tobacco of~
   the value of fifty pounds Sterling money which from him he unjustly detains &ca.
   And whereupon the afd plt. by Thomas Bowne his attry Saith that whereas the -
   afd Deft~. the tenth day of July in the Year of our Lord Christ one Thousand Seven
   hundred and Seventeen at St. Pauls Parish in Kent County within the Jurisdiciõn
   of this Court by his certain Bill Obligatory which he the Said Deft~ Sealed with—
   his Seale and as his deed Delivered here into Court the date whereof is the
   Same day and Year afd oblig’d himselfe his heires Exrs. & Admrs. in the afd Sume
   of five Thousand pounds of good Sound Merchantable leafe Tobacco of the afd value
   of ffifty pounds Sterling money for the true payment of Two Thousand five
   hundred pounds of Merchantable leafe Tobacco in Cask on or before the
   first day of ffebruary next Ensuing the date of the Said Bill and the afd
   Plt~. Indeed Saith that the afd Deft~. hath not paid to the afd Plt~ the afd
   Sume of Two Thousand five hundred pounds of Tobacco on the afd first~
   day of Febry which to him the Same day he ought to have done according
   to the form and Effect of the Said Bill by which Action hath Accrewed to the
   afd Plt~. to Exact and have of the afd Deft~ the afd Sume of five Thousand -
   pounds of Tobacco of the afd value of ffifty pounds Sterling money Yet~ the
   afd Deft~. altho’ often required the afd Summe of five Thousand pounds
   of Tobacco to the Said plt~. hath not paid but that to him to render or pay the
   Said Deft~ hitherto hath denied & Still doth deny & unjustly detain to the damage
   of him the Said plt~. One hundred pounds Sterling money & thereupon he brings
   Sute &ca                      TBowne pr qr. plds : Jno Doe & Richd Roe—
   And the afd Deft being called Came and the Said Plt. by his afd attry prays
