60 June Court 1718 So Sold and Vended to the Inhabitants of this Province and other Persons Liquors and other ordinary Accommodations According to and at the Usuall & respective Rates and Prices Assessed by the Justices & Commissioners for the afosd Kent County in their Said Court Sitting during which Sd time of the Sd Pltffs So keeping Ordinary as last Said viz the twenty Second day of November in the year of our Lord Christ one thousand Seven hundred and Seventeen at St Pauls Parish in Kent County within the Jurisdiction of this Court the Sd Pltff In Consideration the afosd Deft. at the like Speciall Instance and Request of the Said Deft. had then and there last mentioned Vended Sold and delivered unto the Said Deft: for his the Sd Defts: Use diverse liquors and other ordinary Accommodations at the Usuall and Ordinary Rates and prices assessed as afosd. as by the Record of the Sd Rates and Prices here remain: :ing may appear And which Sd liquors and Ordinary Accommodations in an Account Commenceing the twenty fifth day of October in the Year of our Lord Christ one thousand Seven hundred and Seventeen hereto Annexed Specifically Shown— Merchantable Tobacco upon himselfe Assumed and to the Sd Pltff then and there last mentioned faithfully promised that he the Said Defendt. the aforesd Summ of one hundred and Seventy one poundsof Tobacco to the Sd Pltff. when thereunto required would well and truely pay and Content. And whereas also the afosd. twenty Second day of November in the year of our Lord Christ one thousand Seven hundred & Seventeen— there was an Action Depending at the Sd November Court at St Pauls Parish in Kent County within the Jurisdiction of this Court which Action was then Agreed he the Said Deft: paying the Cost and Charges of Sd Action which in the whole amounted unto one hundred and Sixty Seven pounds of Merchantable Tobacco upon— himself Assumed and to the Said Pltff then and there Last mentioned faithfully promised that he the Sd Deft: the aforesd Summ of one hundred and Sixty Seven pounds of Tobacco to the Sd Pltff. When thereunto required would well and truely pay and Content. Nevertheless the aforesd. Deft: his Severall promises and Assumptions afosd in form afosd. made as to the afosd. Severall Summs of money and Tobacco which in the whole amounts unto the Summ of three pounds two Shillings and Six pence of Merchantable Tobacco he hath not minded nor in any wise kept But altho’ he the Said Deft: hath paid and Satisfyed to him the Said Pltff. to the value of three Shillings and three pence Currant money of Maryland of the afosd Summ of three pounds two Shillings and Six pence Currant Money of Maryland and also hath paid and Satisfyed to the Said Pltf. the Summ of two hundred and fourty pounds of Merchantable Tobacco of the afosd Summ of one thousand four hundred and ninety two pounds of Merchantable Tobacco Part. Yet the aforesd. Deft: his promises and Assumptions as to the Summ of two pounds nineteen Shillings and three pence Six pence Currant money of Maryland and the Summ of one thousand two hundred and fifty two pounds of Merchantable Tobacco of the afosd Summ of one thousand four hundred and ninety two pounds of Merchantable Tobacco Residue little regarding but plotting and fraudulently Intending him the Said Pltff. of the afosd Summ of two pounds nineteen Shillings and three pence Currant Money of Maryland and the aforesd Summ of one thousand two hundred and fifty two pounds of Merchantable Tobacco |
