   of Nine Barrells of Indian Corn one thousand five hundred and seventy five
   pounds of merchatnable Tobacco and Seventeen Shillings Currant money of
   Maryland for Sundry Goods then and there to the afd. Deft and to the proper Use
   and behoofe of the afd. by the afd Pltf Sold and delivered in Consideration whereof
   the afd Deft. upon himself assumed and to the Said pltf then and there did faithfully
   that he the said deft. the afd. Summ of Nine Barrels of Indian Corn and one thous=
   and five hundred and seventy five pounds of Merchantable Tobacco and seventeen
   Shillings Currant money afd. to the afd. pltf when thereunto required would well
   and truely pay and Content Nevertheless the afd. Deft. his promise and assump=
   tion afd. in form afd. made as to the afd. Nine Barrels of Indian Corn and the afd Sume of
   tobacco and money amounting to the Sume of one thousand five hundred and Seventy
   [five] pounds of Tobacco and Seventeen Shillings Currant Money afd. he hath not —
   minded nor in any wise kept But altho he the said Deft. hath paid and Satisfied to
   the said pltf. the said Sum of one hundred and twenty pounds of Tobacco and nine
   Barrells of Indian Corn and four Shillings and three pence Currant money afd. of the
   afd Nine Barrells of Indian Corn and one thousand five hundred and seventy five
   pounds of Tobacco and Seventeen Shillings Currant money money afd part, Yett the
   afd. Deft. his promise and assu^mption as to the sum of one thousand four hundred
   and fifty five pounds of Tobacco and twelve Shillings and Nine pence Currant
   money afd of the afd. nine Barrells of Indian Corn and one thousand four hund=
   =red and fifty five pounds of Tobacco and Seventeen Shillings Currant money
   afd. residue litle regarding but plotting and fraudulently intending the said
   plantiff in that behalf Craftily to deceive and defraud the said Sum of one
   thousand four hundred and fifty five pounds of Tobacco and twelve Shillings
   and Nine pence Currant money afd. to the afd Pltf hath not paid nor made Con=
   tent for the same altho to do the Same the said Deft. afterwards vizt. the tenth
   day of february in the Year afd. at the parish County and Jurisdiction afd. by
   the afd Pltf. was thereunto required, But that to the Said pltf to pay or make
   Content he the said Deft hitherto hath refused and still doth refuse to the dam=
   age of the said Pltf. Three thousand pounds of like Tobacco afd. and thereupon
   they bring Suit &c.                                                              Jno Doe }

        And The afd. Deft in his proper person Comes and Defends the force
   and Injury when &c. And Says that he Cannot gainsay the pltf afd his action
   So as against him brought nor Can he say but that the said pltf ought
   to recover his Damages by occasion of the premiss afd to the sum of One
   Thousand four hundred and fifty five pounds of Tobacco and Twelve Shillings
   and Nine pence Currant money with Cost of Suit against him which he the Said
