March Court 1717 [5] Att which Said next Court vizt. the Eighteenth day of March the Same Year last— mentioned the day of return of Said writ Came Simon Wilmer Gent~. high She[rf] of Said County and made return thereof in these words thereon endorsed as folls vizt. Cepi Corpus pr Sumon Wilmer Sherf. . And A Decln being fild when Said writ Issued forth and a Copy thereof Served therewith according to Act~ of Assembly in Such Case made was as folls. vizt. Kent County Ss Nathaniell Pearce of Kent County Planter alis Dics Nathaniel Pearce of Kent County was Summoned to Answer unto William Frisby of a plea that he render him- the full and just Sume of Nine hundred and Twenty pounds of good Merchan: :ble Leafe Tobacco in Cask to Containe the Same of the value of Nine pounds Sterling money which from him he unjustly detains &ca. . And Whereupon the afd Plt. by Thomas Bowne his attry Saith that whereas the afd Deft~. the Twenty Second day of June in the Year of our Lord Christ one Thousand Seven hundred and Seventeen at St. Pauls Parish in Kent County within the Jurisdiciõn of this Court by his Certain writing obligatory which he ye. Said Deft~. Sealed with his Seale and as his deed delivered hereinto Court brought the date whereof is the Same day and Year afd granted himselfe holden and firmly bound unto the afd Plt~ in the afd full and just Sume of Nine hundred & Twenty pounds of good Merchanble Leafe Tobo in Caske to containe the Same of the afd value of Nine pounds Sterling money to be paid unto the Said Plt~. when thereunto required the afd Sume of Nine hundred and Twenty pounds of Tobacco to the Said Plt~ hath not paid but that to him to render or pay the Said Deft~ hitherto hath denied and Still doth deny and unjustly detaine to the damage of him the Said Plt~. Eighteen pounds of~ like money afd and thereupon he brings Sute &ca TBowne pr Querr plds. Jno Doe & Richd Roe— And the afd Deft~ being called came and the Said Plt. by his afd attry prayd yt~. the afd Deft~ might give Special baile to the afd accõn which is granted and— on which Robert Meeks and John Johnson both of Said County here in Court~ came and Acknowledged themselves Joyntly and Severally Special baile in the afd Accõn and they and either of them do undertake for the Said Deft~ ye payment of the Debt~ afd and Cost~. thereon accrueing if in Case the afd Plt~ Shall obtaine Judgment in the Said Accon of Debt and the Said Deft~ the Condem: :nation Shall not Satisfie nor himselfe to the Custody of the Sherff of Said County deliver or that the afd Robert Meeks and John Johnson the body of the Said Deft~ Shall not render &ca—— After which the Said Deft~ appeared to the above Accõn and Saith that he Cannot gainsay the Accõn afd of him the Said Plt~. nor but that the writing obligatory above mentioned is his Act and deed and is willing that Judgment~ Should be entered for the Same and Cost accrueing = Therefore it is Considered by the Court here vizt. this Twentieth day of March Anno Domini One Thousand Seven hundred and Seventeen That the afd Plt~. William Frisby do Recover against~ the Said Deft~. Nathaniel Pearce as well the afd Sume of Nine — hundred |
