    442                                March Court 1719
   Plt when thereunto required would well and truly pay and Content
   Nevertheless the afd Deft his promises and assumptions afd in forme
   afd made as to the afd Severall Sumes of Tobacco in the whole —
   amounting unto one Thousand Eight hundred and forty Eight
   pounds of Merchantable Tobacco he hath not regarded But altho’
   he the Said Deft hath paid and Satisfied to the Said Plt the
   Sume of Thousand Seventy Eight pounds of Tobacco of the afd
   Sume of one Thousand Eight hundred and forty Eight pounds
   of Tobacco Part Yet the afd Deft his Promises and assumptions
   as to the Sume of Seven hundred and Seventy Eight pounds
   of Tobacco of the afd Sume of one Thousand Eight hundred and forty
   Eight pounds of Tobacco Residue little minding but fraudulently
   Intending him the Said Plt. of the afd Sume of Seven hundred and
   Seventy Eight pounds of Tobacco Craftily to deceive and defraud
   the afd Summe of Seven hundred and Seventy Eight pounds of
   Tobacco to the Said Plt altho’ he the Said Deft afterwards vizt the
   Thirtieth day of March in the Year afd and often after at the Parish
   County and Jurisdiciõn afd by the Said Plt. was hereunto required
   hath hath not paid nor made Content for the Same but that to
   him to pay or make Content for the Same hitherto hath denyed
   and Still doth deny to the damage of him the Said Plt two —
   Thousand pounds of Like Tobacco and Thereupon he brings Suite
   &ca.
                                         TBowne pr Querr Plds Jno Doe & Rd Roe
   and the afd Deft by David Macbride his atry comes and
   Defends the force and Injury when &ca. And prays leave to
   imparle hereunto untill next Court and he hath it And the Same
   day is given the Plt also —
      Att which Said next Court to wit the 16th. day of June Anno
   Domi 1719 comes again as well the Said Plt by his Said Attry as
   the Said Deft. by his Said Attry. And the Same cause was Continued
   untill the then next Court
      Att which Said next Cout to wit the 18th day of August Anno.
   Domi: 1719 comes again as well the Said Plt. by his Said Attry as
   the Said Deft by his Said Attry and the Same cause was Continued
   untill the then next Court
      Att which Said next Court to wit the 17th day of November
   Anno Domi 1719 comes again as well the Said Plt by his Said
   Attry as the Said Deft by his afd Attry and the Same cause was
