    440                              March Court 1719
   Said County . And the afd Deft by David Macbride his attry.
   comes and defends the force and injury when &ca. and Say’th that
   he did not assume upon himselfe in manner & form as the afd
   Plt above against him Complaineth and of this he puts himselfe
   upon his Country
        and the Plt in like manner
   Thereupon Command is given to the Sherf of Kent County that
   he Immediately Cause to come here twelve &ca. By whome &ca.
   Who neither &ca. To Recognize &ca. Because as well &ca. of which
   Said Precept the Said Sherf to wit Simon Wilmer Gent. now here
   at this day to wit the 21st. day of March Anno Domi 1719 makes
   return that he hath here ready twelve &ca. as by his precept he
   was Commanded and now here afterwards to wit the day and —
   year last mentioned Comes againe as well the Said Plt by his
   attry afd as the Said Deft by his attry afd and the Jurors of that
   Jury being Impannelled who being Called Likewise came to wit
   Thomas Piner Robert Meeks John Ashley Robert Mansill William
   Brown Richard West John Rollinson George Reed William Graves
   William Blackiston Arthur Foreman John Reed who being duely
   Elected tryd & Sworn to Say the truth in the premises upon their
   Oath do Say that the Said they find for the Plt and that the Deft
   did assume upon himselfe in manner and form as the afd Plt
   above against him Complaineth and find damages one Thousand
   one hundred Seveny Seven pounds of Tobacco with Cost of
   Suite Therefore it is Considered by the Justices here to wit the
   21st. day of March Anno Domi 1719 afd That the Said William Frisby
   Recover against the Said John Jones as well the Sume of one
   Thousand one hundred Seventy Seven pounds of Tobacco Damages
   by the Jury afd found. as also the Sume of Eight hundred Andty^Three
   Six pounds of Tobacco by the Court here adjudged to him for his Costs
   and Charges by him about his Suite in this behalfe Expended
   And the Said Deft. in mercy &ca.
      Att the Prayer of the Plt by his Attry afd the Said Deft is Committed
   into the Custody of the Sherf of Said County in Execution and there to
   Remain untill the damages afd & Cost in the Judgment he Shall
   Satisfie
