March Court 1719 435 of a Certain Samuel Peale John Carpenter & Company Merchts. unless he the Said Patrick Ninance by himselfe or his attry Shall appear and answer unto the Said Samuel Peale John Carpenter & Company Merchts. in a plea of Trespass of the Case According to Law and that by good and Lawfull men of your Bailywick you make known unto ye prson or prsons in whose hands you make the Same Attachment that he She or they be and appear before the Justices of our Said Court to be held at the time & place afd to Shew cause if any he She or they have why the Same goods Chattells rights or Credits So attached in his her or there hands ought not to be Condemned According to Law if to him her or them it Shall Seem meet and how you Shall Execuste this writ that you make known unto our Said Justices at the day and place afd and have you then & there this writ Witness Nathaniel Hynson Gent chiefe Justice of our Said Court this 22d day of November in the fourth Year of our Dominion &ca. Anno Domi 1718 TBowne pr qr Jams Smith Clk Att which Said Court to wit the 17th day of March Anno Domi 1718 came Simon Wilmer Gent. high Sherf of Said County being the day of return of the afd writ of Attachment and makes return Thereof to the Court here Endorst as followeth vizt. By Vertue of the within writ to me Directed I Certifie to the Justices within mentioned that I have attached of the Goods Chattells Rights & Credits of the within named Patrick Ninance the Sum of Sixteen hundred pounds of Tobacco in the hands of Thomas Tolley and have ye Same here ready to be Condemned According to Law to the Use of the within named Samuel Peale John Carpenter & Company in part of the within mentioned Sum of two Thousand and four hundred pounds of Tobacco and have made known to the Same Thomas Tolley before William Pope & Thomas Cook good & Lawfull men of my Bailywick that the Said Thomas Tolley be and appear at the time & place within mentioned to Shew Cause if any he hath why Condemnaciõn of the Same Should not be made according to Law as the within writ Exacteth and Requires pr Simon Wilmer Sherf and The afd Garnishe by Michael Howard his attry comes and defends the force and injury when &ca. and prays leave to imparle hereunto untill next Court which is granted the Same day is given the Plt also Att which Said next Court to wit the 16th day of June Anno Domi 1719 comes the afd Plts by their attry afd as also the Said Garnishe by his Said attry but the Said Cause was Continued untill next Court Att which Said next Court to wit the 18th day of August Anno Domi 1719 comes againe the afd Plts by their attry afd And the Said Garnishe by his Said Attry but the Said Cause was Continued untill next Court Att |
