    404                                March Court 1719
   Tobacco in manner as in the Said Account Sett forth of which the Said
   Deft then and there had Notice Nevertheless the afd Deft his
   promises & Assumptions afd in forme afd made in no wise regarding
   but plotting & fraudulently Intending the Said Plt in this behalfe
   Craftily & Subtilly to defraud & deceive the afd Sums of Merchantable
   Tobacco in the whole amounting unto Eight hundred & Two pounds
   of Merchantable Tobacco or any Part thereof to the Same Plt
   he hath not paid nor in any wise made Content for the Sume altho’
   to do the Same the afd Deft afterwards vizt. the twenty fourth
   day of February at the Parish County and Jurisdiciõn afd & often
   afterwards by the Same Plt was thereunto required but that to him
   to pay or Content hitherto hath denied and Still doth deny to the
   damage of him the Said Plt one Thousand pounds of the like Tobo
   & thereupon he brings Suite &ca.                                                     { Jno Doe

   and now at this Court to wit the 15th day of March Anno Domi 1719 comes
   the afd defendant and defends the force and injury when &ca. And Says
   that he Cannot gainsay the Plt his accon afd So as afd agst him brought
   nor but that the Said Plt ought to Recover his Damages by occation
   of the premises afd Amounting to the Sume of four hundred and one
   pounds of Tobacco with Cost of Suite Which the Said Plt does not
   gainsay Therefore it is Considered by the Justices here the 15th day of
   March Anno Dom 1719 Afd That the Said John Vincent do recover agst.
   the Said Daniell Rooche as well the Sume of four hundred and one
   pounds of Tobacco Damages afd in forme afd Confessed as also The Sume
   of Two hundred thirty Seven pounds of Tobacco by the Court here adjudged
   to him for his Cost and Charges about his Suite in this behalfe laid out
   and Expended And The Deft. in mercy &ca
