March Court 1717 35 Merchantable Tobacco as in the Said Account Shewn and at the like Special instance and request of the afd Deft~ had then and there paid to a Certain Elizabeth True and to the proper use and behoofe of the Said Deft Two hundred & fifty pounds of Tobacco upon— himselfe assumed and to the Said Plt~ then and there faithfully promised that he the Said Deft~ the afd Sumes of Three Thousand Eight hundred and Eighty Eight pounds of Merchantable Tobacco and the afd Sume of Two hundred & fifty pounds of Tobacco unto the Said Plt. when thereunto to required would well and truly pay & Content And that~ whereas also the afd Deft afterwards vizt. the afd fifth day of September in the Year afd at the Parish County & Jurisdiciõn afd In Consideration that the afd Plt. at the like Speciall Instance and request of the afd Deft had then and there last mentioned Sold and delivered unto the Said Deft and to the proper use and behoofe of the Said — Deft Divers Goods and Merchandizes in ann Acco . hereunto Annexed Specifically Sett forth upon himselfe Assumed and to the Said Plt. then and there last mentioned faithfully promised that he the Said Deft~ So much Merchantable Tobacco as the afd last mentioned Goods and Merchandizes sold and delivered as afd at the time of the Sale and delivery thereof at Reasonable Rates and prices were worth and amounted to unto the Said Plt. when thereunto required would well and truly pay and Content And the afd Plt. indeed Saith that the afd last mentioned Goods and Merchandizes Sold and delivered as afd at the time of the Sale and delivery thereof at reasonable Rates and prices were worth and Amounted unto the— Summ of Three Thousand Eight hundred and Eighty Eight pounds of Merchantable Tobacco in Manner as in Said Accot Set forth of which the Said Deft~ then and there last mentioned had Notice Nevertheless the afd Deft~ his Severall promises & assumptions afd in forme afd made as to the afd Severall Sumes of Tobacco which in the whole amounts unto the Sume of Eight Thousand and Twenty Six pds of Merchantable Tobacco he hath not. minded nor in any wise kept but altho’- he the Said Deft~ hath paid and Satisfied to him the Said Plt~ to the value of~ Two hundred & Seventy pounds of Tobacco of the afd Sume of Eight Thousand and Twenty Six pounds of Tobacco part Yett the afd Deft~ his promises & assumptions as to the Sume of Seven Thousand Seven hundred and fifty Six pounds of Tobacco- of the afd Eight Thousand and Twenty Six pounds of Tobacco residue little regard: :ing but plotting and fraudulently Intending him the Said Plt~ to deceive and — defraud the Said Sume of Seven Thousand Seven hundred and fifty Six pounds of Tobacco the Said Deft~ him the Said Plt~. hath not paid nor made Content for the Same altho’ to pay the Same he the Said Deft~ the Eighteenth day of Octobr. in the Year afd at the Parish County & Jurisdiciõn afd was thereunto required but the Said Deft the afd Sume of Seven Thousand Seven hundred and fifty Six - pounds of Tobacco to the Said Plt~ to pay or Content hitherto hath denyed and Still doth deny to the damage of him the Said Plt.
