the day of return of Said writ Endorst Cepi Corpus pr Simon Wilmer Sherf. and the afd Deft by Michael Howard his attry comes and defends the force and injury when &ca. And prays leave to imparle hereunto untill next Court and he hath the Same day is given the Plt also Att which Said next Court to witt the 16th day of June Anno Domi 1719 comes again as well the Said Plt by Thomas Bowne his attry as rule is given to the Said Plt to fill his declaration in twenty days after Court otherwise the Said Deft to have a non Sute against the Said Plt for want of the Same and thereupon the Same action is Continued untill the next Court Att which Said next Court to wit the 19th day of August Anno Domi 1719 And the Decln in the Said Cause being not filed according to the rule given for the Same And the Said Deft by his attry afd comes and offers himselfe against the Said Charles Smith in the plea afd But the Sd Charles Smith does not prosecute his writ afd against the Said Robert Maxfield whereby the Said Robert Maxfield remains wholly unprosecuted Therefore it is Considered by the Justices here to wit the 19th day of August Anno Domi 1719 afd That the Said Charles Smith take nothing by his writ afd but be in mercy for his false Clamor and that the Said Robert Maxfield go thereof without Day And also it is Considered by the Justices here that the Said Robert Maxfield Recover against the Said Charles Smith the Sume of one hundred and fifty Seven pounds of Tobacco by the Court here adjudged to him for his Costs and Charges by him about his according to the forme of the Statute &ca Jams Smith Clk
