   to the Court here on the third Tuesday in August to wit the 18th day of the
   Same month Anno Domi 1719 beind the Day of return of Said writ Endorst

Planter was Summoned to Answer unto Owen MacGragh
   of a plea that he render him the Just & Lawfull Sume of Six hundred
   pounds of good Sound Merchantable well qualified Tobacco in Caske to
   Containe the Same of the value of Six pounds Sterling money and –
   two barrells of Indian Corne of the value of Sixteen Shillings Sterling
   money which he unjustly detaines    .    .    . And Whereupon the
   afd Plt by Thomas Bowne his attry Saith that whereas the afd Deft
   the Nineth day of November in the Year of our Lord Christ one —
   Thousand Seven hundred and Seventeen by his certain Bill obligatory
   which he the Said Deft Sealed with his Seale and as his deed delivered
   hereinto Court brought the date whereof is the Same day and Year afd
   bound himself to pay unto the Said Plt the afd Just and Lawfull Sume
   of Six hundred pounds of good Sound Merchantable well Qualified —
   Tobacco in Casque to Containe the Same of the value of Six pounds —
   Sterling money and the afd two barrells of Indian Corne of the value
   of Sixteen Shillings Sterling money afd at or about the tenth day of
   October which Shall happen in the Year of our Lord Christ one
   Thousand Seven hundred & Eighteen the Said Tobacco to be paid on
   the then Dwelling plantation of the Said Deft in Kent County afd
   within the Jurisdicion afd Yett the afd Deft altho’ often required the
   afd Just and Lawfull Sume of Six hundred pounds of Sound Merchantable
   well qualified Tobacco or the two barrells of Indian Corne or either of them
   to the afd Plt hath not paid but that to him to Render or pay hitherto
   hath Denied and Still doth denie unjustly detaine to the
   damage of him the Said Plt twelve pounds Sterling money
   and thereupon he brings Sute &ca.
                                                        TBowne pr Querr plds Jno Doe Richd Roe
      Whereupon at the Prayer of the Plt by his Attry the Said Deft is
   adjudged to give Special baile to the Accõn afd And that the Sherf of Said
   County keep the Said Deft in Safe Custody untill he Shall Give Special as
   afd Thereupon Benjamin Griffiths of Said County her in Court undertake
   for the Said Thomas Hart that in case the Said Owen Macgragh Shall
   recover Judgment in the Plea afd against the Said Thomas Hart or that
   he the Said Thomas Hart Shall be therein Convict that then he the Said
   Thomas Hart Shall pay the Condemnation of the Court thereupon or render
   his body to the Custody of the Sherf of Kent County in Satisfacion there:
   =of or that the Said Benjamin Griffiths Shall do it for him
