    248                                     March Court 1718
   the afd full Sum of two Thousand Eight hundred pounds of Tobacco of the afd value of
   twenty Eight pounds Sterling money And the afd Mathias Indeed Saith that the
   afd John the afd Sum of one Thousand & four hundred pounds of Tobacco to the afd
   James in his life time or to the afd Matthias after the death of the Said James
   to which Said Mathias Administration of all and Singular the goods and Chattells
   Rights & Credits which were of the afd James at the time of his death by William
   Bladen Commissary Generall of this Province of Maryland the fourth day of March
   Annoqe Domini Seventeen hundred and fourteen at Annapolis in the Parish
   County & Jurisdiciõn afd was Lawfully Committed hath not paid which he ought
   to have paid according to the forme and Effect of the afd Bill obligatory altho’
   to pay the Same he the Said John the twenty Second day of August in the Year
   afd by the Said James in his life time and after the death of the Said James by
   the Said Mathias vizt. the Sixth day of February in the Year of our Lord Christ
   Seventeen hundred & Sixteen at S.t pauls Parish in Kent County afd within the
   Jurisdiciõn of this Court was thereunto required By which Accõn hath accrewed
   to the Said James in his life time and to the afd Mathias after the death of
   the Said James to Exact require and have of the afd John the afd two Thousand
   & Eight hundred pounds of Tobacco Yet the afd John altho’ often required
   the afd two Thousand & Eight hundred pounds of Tobacco to the afd James
   in his lifetime or to the afd Mathias after the death of the Said James hath
   not paid But that to the afd James in his lifetime and to the afd Mathias
   after the death of the Said James to pay hath altogether denied and that to
   the Said Mathias as Yet doth deny and unjustly detain to the damage of
   the Said Mathias the value of forty pounds Sterling money and in delay –
   of the Execution of the Administracõn afd and thereupon he brings
   Sute And brings hereinto Court the Letters of Administracon afd which
   Testie &ca TBowne pro Querr plds John Doe & Richd Roe——
   and the afd Deft came into Court in proper person and Saith that he
   Cannot gainsay the Accõn afd nor but that the writing afd is his Act
   and deed and that he is willing that Judgment Should be entered for
   for the afd Sume of Two Thousand and Eight hundred pounds of Tobacco the
   Debt afd and Cost threon accruing Therefore it is Considered by the Court here vizt. this
   twentieth day of March Annoqe Domini one Thousand Seven hundred and
   Eighteen That the afd Mathias Vanderheyden Admr. of the afd James Barbott
   deceased Recover against the afd Deft John Budd as well the afd Sume
   of two Thousand Eight hundred pounds of Tobacco Debt as also the
   Sume of Three hundred ninety Eight pounds of Tobacco Cost by
   the afd Plt about his Sute in this behalfe expended and by the
   Court here of his assent adjudged and the Said Deft in mercy
   &ca
