November Court 1718 193 And the afd Def.t in his proper person Comes and defends the force and Injury when &c and Saith that he cannot Gainsay the plt afd his accon So as agt him brought nor but that the Writeing Obligatory above mentioned is his act and Deed and is willing that Judgemt. Should be Entered agst: him for the abovesd Sum of four hundred and Ninety four pounds of Tobacco his Debt afd. So as afd: him brought and the Costs thereon accrueing which the plt doth not Gainsay Therefore it is Considered by the Court here this Twenty first day of November Anno Domi One thousd Seven hundred and Eighteen that the afd John March Recover against the afd John Gilbert as well the afd Sum four hundred and Ninety four pounds of Tobacco his Debt af.d in form afd Confessed as also the Sum of pounds of Tobacco by the Court here adjudged to him for his - Costs and Charges by him about his Suit in this behalf laid out and Expended and the Def in Mercy &c This Judgemt is Entered for want of a Declaration Jas Smith Clk
Whereupon at the þrayer of the plt the Def:t is adjudged to give Special Bail^to ye Accõn afsdThereupon Joseph Wright of Said County Planter present here in Court Undertakes for the said Thomas Hattenpenny that in Case the afd Peter Harwood and Norton Knatchbull admrs as afd: Shall Recover Judgemt in the afd Accõn agst: the Said Thomas Hattenpenny or that he the Said Thomas Hattenpenny Shall be therein Convict that then the Said Thomas Shall pay the Condemnation of the Court thereupon or Render his body unto the Custody of the Sherf of Said County in Satisfaction thereof or that he the said Josep^h Wright will do the Same for him.
