November Court 1718 159 Sherrife of Kent County greeting wee Command you that you Attach any the goods Chattells Rights or Credits of Charles Johnson late of Kent County Mariner if they Shall be found in your Bailywick to the value of Nine pounds Seventeen Shillings Currant money & Seven hundred pounds of Tobacco and when you have the Same So attached or any part thereof the Same in your Costody Safe keep So that you have them before the Justices of our next County Court to be held at our Court house in the Town of Chester in Said County on the third Tuesday in Novembbr. next then and there to be Condemned according to Act of assembly to & for the use of a Certain Nathaniel Hynson unless he the Said Charles Johnson by himself or his attry Shall appear and Answer unto the Said Nathaniel Hysnon in a plea of Trespass upon the Case according to Law and that by good and Lawfull men of your Bailywick you make known unto the person or persons in whose hands you make the Same Attachment that he She or they be and appear before the Justices of our Said Court to be held as afd to Shew cause if any he She or they have why the Same goods Chattells rights or Credits So attached in his her or there hands ought not to be Condemned according to Law if to him her or them it Shall Seem meet and how you Shall Execute this writ that you make known unto our Said Justices at the day & place afd and have you then and there this writ witness Nathaniel Hynson Gent chiefe Justices of our Said Court this 22d day of August in the fourth Year of our Dominion &ca. Anno Domi 1718 TBowne pr Querr JamsSmith Clk Att which Said next Court vizt. the Eighteen day of November the Same year last mentioned the day of return of Said writ Came Simon Wilmer Gent. high Sherrife of Said County and made return thereof in these words thereon endorsed as folls vizt. By vertue of the within writ to me directed I Certifie to the Justices within mentioned that I have attached of the goods and Chattells of the within named Charles Johnson one old Boat Sailes & riggin of the value of three pounds tenn Shillings Currant money in the hands of the within named Nathaniel Hynson and have the Same ready to be Condemned According to Law to and for the use of the within named Nathaniel Hynson and have made known to the party in whose hands I have made the Same Attachment and before James Horsley and John Derrick Good and Lawfull men of my Bailywick that he be and appear at the time and place within menti: :oned to Shew cause if any he have why Condemnation of the Same Goods and Chattells Should not be Condemned According to Law to Satisfie unto the within Nathaniel Hynson part his damages and Cost as the wihtin writ requireth pr Simon Wilmer Sherf and now at the Said Court came the afd Plt by Thomas Bowne his - attorney and prays Condemnation of the afd old Boat Sailes and rigen of the value of three pounds tenn Shillings in the hands of the abovesaid Nathaniel Hynson the goods and Chatells of the afd Deft and the afd Nathaniel Shewing no cause why the Same Should not be Condemned to the use of the afd Plt. Therefore it is Considered by the Court here vizt. this twenty first day of November Anno Domini One Thousand Seven hundred and Eighteen That the afd goods and Chattells of the afd Charles John |
