136 August Court 1718 Said County to Answer unto James Rae of a plea of Trespass of the Case and that he have then and there the Said writ &ca. Att which Said next Court vizt. the Seventeenth day of June Anno Domini One Thousand Seven hundred and Eighteen the day of return of Said writ came Simon Wilmer Gent high Sherf of Said County and made return thereof in these words thereon Endorsed as folls vizt. Cepi Corpus pr S:Wilmer Sherf. and the afd Deft in his proper person appeared to the afd Accon and prayd liberty thereof to imparle thereto and to Answer at next Court which is granted the Same day was given the Plt also Att which Said next Court vizt. the nineteenth day of August the Same Year last mentioned The Said Cause Standing for tryall came the Said Plt by Thomas Bowne his attry and the Said Deft. in his proper person and . the Plt afd by his afd affry declares as folls vizt. Kent County pr Nathaniel Pearce of Kent County Planter Stands attached to answer unto James Rae of a plea of Trespass of the Case and Whereupon the afd Plt by Thomas Bowne his attry Complains that Whereas the afd Deft vizt. the nineth day of Aprill in the year of our Lord Christ One Thousand Seven hundred and Sixteen at St. Pauls Parish in Kent County within the Jurisdiciõn of this Court . In Consideration that the afd Plt. at the Special Instance and request of the afd Deft had then there Sold and delivered unto the afd Deft and to the proper use and behoofe of the afd Deft divers Goods and Merchandizes in an Accot hereunto Annexed Sett forth upon himselfe assumed and to the Said Plt. then and there faithfully promised that he the Said Deft. So much Currant Silver money of America as the afd Goods & Merchandizes Sold and delivered as aforesaid at the time of the Sale and delivery thereof at Reasonable Rates and prices were worth and - Amounted to unto the Said Plt when thereunto required would well and truly pay and Content And the afd Plt. Indeed Saith that the afd Goods and Merchandizes Sold and delivered as afd at the time of the Sale and delivery thereof at Reasonable Rates and prices were worth and amounted unto the Same of Two pounds Twelve Shillings and Six pence Currant Silver money of America in Manner as in the Said Accot. Sett forth of which the Said Deft then and there had Notice . .And that Whereas also also the afd Deft afterwards vizt. the Twenty third day of August in the year of our Lord Christ One Thousand Seven hundred and Seventeen at St. Pauls Parish in Kent County within the Jurisdiciõn of this Court In Consideration that the afd Plt at the like Special Instance and request of the afd Deft had then and there last mentioned Sold and delivered unto the afd Plt by the hands of a Certain John Macnemarar and to the proper use and behoofe of the afd Deft. Eight bushells of Merchantable Wheat for the Sume of Three hundred and twenty pounds of Merchantable Tobacco and Tenn bushells of Merchantable Indian Corn for the Sume of Two hundred pounds of Merchantable Tobacco which in the whole Amounts unto the Sume of five hundred and Twenty pounds of Merchantable Tobacco upon himselfe Assumed and to the Said Plt then and there last mentioned faithfuly promised that he the Said Deft the afd Sume of five hundred and Twenty pounds of Merchantable Tobacco unto the Said Plt when thereunto required would well and truly pay and Content and that Whereas also the afd Deft afterwards vizt. the Twenty third day of August in the Year of our Lord |
