he oweth and from him unjustly by ye name of new Currancy which to him he oweth and from him unjustly detaineth and one Substantial Cart with Cart Sadle Coller & Heams of the value of four pounds Currant money of Maryland whi[ch] from him he unjustly detaineth and whereupon the afd Plt by Thomas Bowne his attry Saith that whereas the afd Deft. the Twenty Eight day of March in the Year of our Lord Christ one Thousand Seven hundred and thirteen at St: Pauls Parish in Kent County wihtin the Jurisdiciõn of this Court by his Certain Writeing obligatory which he the Said Deft. Sealed with his Seale and as his deed Delivered here into Court brought the date whereof is the Same day and Year afd Acknowledged himselfe to owe unto the afd plt. the afd full & just Sume of Six pounds Seventeen Shillings Currant money of Maryland by ye name of New Currancy and the Substantial Cart Sadle Cart Sadle Coller and Heams of the afd value of four pounds Currant money of Maryland to be paid^unto the afd Plt when there: unto required Yet the afd Deft altho’ often required the afd Sume of Six pounds Seventeen Shillings Currant money of Maryland or new Currancy Cart with Cart Sadle Coller and Heams to the Said Plt. hath not paid but them to him to render or pay the Said . Deft hitherto hath denied and Still doth deny and the afd Cart with Cart Sadle Coller and Heams unjustly doth detain to the damage of him the Said Plt Twenty pounds Currant money of Maryland and thereupon he brings Sute &ca TBowne pr Querr plds Jno Doe & Rd Roe and the afd Plt in his proper person appeared to the afd Accõn and prayd liberty thereof to imparle thereto & to Answer at next Court which was granted the Same day was given the Plt Att which Said next Court viz the nineteenth day of August Annoq Domini one Thousand Seven hundred and Eighteen The Court gives rule that the Deft plead to the afd Accon before the twenty first day of Same month last Said otherwise Judgmts. to be rendered for want of A plea The time being out And The Deft afd being Solemnly called came not nor any person in his behalf doth Shew cause why Judgmt Should not be rendered whereby the afd Plt may Still remain against the Said - Deft without defence Therefore it is Considered by the Court here vizt. this Twenty first day of August Anno Domini One Thousand Seven hundred and Eighteen That the afd Plt John Dowdall Recover against the afd Deft George . Gleaves as well the afd Sume of Six pounds Seventeen Shillings Currant money and One Substantial Cart with Cart Sadle Coller and Heams the Debt afd as also the Sume of four hundred and Seventy five pounds of Tobacco Cost by the afd Plt about his Sute in this behalfe Expended and by the Court here of his assent adjudged and the Said Deft in mercy &ca.
