   110                                        August Court 1718
   unto the afd Plt. the Sume of Six hundred and Seventy Eight pounds of Tobacco
   of the afd Sume of Two Thousand one hundred and Seventy Two pounds of Tobacco
   part yet the afd Deft his promises and Assumptions as to the Sume of one Thousand
   four hundred and Ninety four pounds of Tobacco of the afd Sume of Two Thousand
   one hundred and Seventy Two pounds of Tobacco residue little regarding butt   -
   plotting and fraudulently Intending him the Said plt. of the afd Sume onf one Thousand
   four hundred Ninety four pounds of Tobacco craftily and Subtilly to deceive and
   defraud the afd Sume of One Thousand four hundred and Ninety four pounds of—
   Tobacco to the Said Plt. altho’ he the Said Deft afterwards vizt. the Twelfth day
   of January in the year afd and often after at the parish County and Jurisdiciõn afd
   by the Said Plt was thereunto required hath not paid nor made Content for
   the Same Byt that to him to pay or make Content for the Same hitherto hath
   denied and Still doth deny to the damage of him the Said Plt Three Thousand
   pounds of Tobacco and thereunto he brings Sute &ca                                Jno Doe

   Maryland May ye 30th 1718 Then Capt. William Rock made Oath on ye holy —
   Evangelist that the above Accot. is Just & Trew & that he have not Recd any —
   part or parcell thereof but what he have Given due Creditt for Sworn before me
   being one of his Lord Ships Justices of ye Province of Maryland &ca...

   And Thomas Bowne attry for the afd Plt Saith that the Plt. not being an Inhabitant
   of this County prays that he may be taken as Securety for Cost which is granted on—
   which The afd Thomas Bowne comes into Court and Saith that if he afd Deft Should
   appear to the afd Accõn and the Said Plt Should be Cast in the Same That then he
   will pay the Cost to the afd Deft if the Plt. pay it not himselfe
    And the afd Deft. being called came And the Same Plt. by his attry afd prays that
   the Said Deft may give Special baile to the afd Accõn which is granted and that he be kept
   in Safe Custody by the Sherf of Said County untill he Shall give Speciall baile as afd
   after which Andrew Ruddle of Said County here in Court Cometh and Acknowledges
   himselfe as Special baile in the afd Accõn and doth undertake for the afd Deft
