of Maryland of the one part & Nicholas B. Worthington of the other part
whereas Henry Wilson the father of the said W.m O. Wilson did on the seventeenth
day of November eighteen hundred & forty three duly execute a
bond of replevin to a certain Vachel Sevier which was also signed by
Nicholas B. Worthington & William O. Wilson the parties to this instrument
as sureties of the said Henry Wilson for the performance of the
condition of said bond  And whereas it is the desire of the said W.m O
Wilson to secure the said Nicholas B. Worthington against all loss
damage charges costs & payments by reason of his liability as surety in
the said bond of his father Henry Wilson the said William O. Wilson
is willing to execute these presents.  Now this Indenture witnesseth
that for and in consideration of the premises & of one dollar current
money in hand paid by the said Nicholas B. Worthington to the
said W.m O. Wilson the receipt of which is hereby acknowledged the
said W.m O Wilson hath granted bargained & sold & by these presents
doth grant bargain & sell unto the said Nicholas B. Worthington
his executors administrators & assigns all & singular the following
named goods & chattels to wit one sorrel mare and his interest
amounting to two thirds of the crops of corn tobacco & other crops
growing upon the land rented by him of Mrs Parrott upon
which he now resides.  To Have and To Hold unto the said Nicholas
B Worthington his executors administrators & assigns to his & their
own use & behoof.  Provided always & it is declared to be the true intent
& meaning of these presents that if the above named Henry
Wilson or the said W.m O. Wilson or both of them shall pay &
satisfy all costs charges & judgments which have been or may be
rendered against or be or become due by the above named Henry
Wilson for not performing the matters & liabilities in the condition
of the bond aforesaid contained & expressed & also save & keep harmless
& indemnify the said Nicholas B. Worthington from & for all
costs charges payments & liabilities by reason of his signing the
said bond as one of the sureties aforesaid then & in such case these
presents & every matter & thing therein contained shall cease determine
& be utterly null and void any thing herein contained to
the contrary notwithstanding.  In Testimony whereof the said W.m
O. Wilson hereto signs his hand and affixes his seal the day & year first
aforesaid mentioned
