492 thousand eight hundred and fifty one a certain writ of the State of Maryland usually denominated a writ of fieri facias was issued by James S. Owens a Justice of the peace of the said state in and for the said county to the said John E. Gardner constable as aforesaid directed reciting that "whereas before the subscriber a Justice of the peace of the said State in and for the said county on the twentieth day of June Anno Domini one thousand eight hundred and fifty one a certain James Kent for the use of Bennett M Thomas by Judgement of the said Justice recovered against John W. Greenwell as well the sum of Forty two 15/100 dollars with interest from the first day of June Anno Domini one thousand eight hundred and fifty one as well as the sum of ninety seven cents for his cost and charges by him about his suit in that behalf laid out and expended the said constable was therefore by the said writ of fieri facias commanded that of the goods and chattels lands and tenements of the said John W. Greenwell he shall cause to be made and levied the debt damages costs and charges aforesaid and that he shall have these sums before the said Justice on the twenty fourth day of August then next to render unto the said James Kent use of Bennet M Thomas the debt damages costs and charges aforesaid and also that the said constable should have then and there that writ and whereas the said writ came to the hands of the said constable on the fourteenth day of July Anno Domini one thousand eight hundred and fifty one the date thereof and in virtue thereof and in pursuance of the command therein contained the said constable laid the same upon a negro woman named Easter and did seize and take into execution the said negro woman Easter as the property of the said John W. Greenwell in or to which he had a right title property claim and demand at Law or in Equity and whereas the said constable after givin the due and legal notice required by the act of Assembly in such cases made and provided of the time place manner and terms of sale did on the twentieth day of August Anno Domini one thousand eight hundred and fifty one agreeable to such notice set up and expose to put the sale to the highest bidder for cash all the right title property claim and demand at law and in equity of the said John W. Greenwell in and to the said negro woman Easter and the said Anna E. Thomas being then and there the highest bidder because the purchaser thereof for the price or sum of Fifty two 6/100 dollars. And this Bill of sale Witnesseth that in pursuance of the premises and for and in consideration of the sum of Fifty two 6/100 dollars to him the said John E. Gardner constable as aforesaid in hand paid by the said Anna E. Thomas at and before the sealing and delivery of these presents the receipt whereof the constable doth hereby acknowledge to the said John E. Gardner constable as aforesaid hath bargained and sold and by these presents doth as fully and effectually as the law fully may or can bargain and sell release and confirm unto the said Anna E. Thomas all the right title interest property claim and demand at law and in Equity of the said John W. Greenwell in and to the said negro woman Easter who was liable to be sold under the said writ and which he the said John E. Gardner constable as aforesaid might or could lawfully sell by force of said writ. To have |
