415 to me the said Henry Myers by the said Robt Lemmon Jr & Co for and on account of Charcoal which I have agreed to deliver the said Robt Lemmon Jr & Co as per an agreement dated on the 29th day of September 1849 Now I the said Henry Myers in consideration of the premises and of the sum of one dollar to me by the said Robt Lemmon Jr & Co in hand paid the receipt whereof I hereby acknowledge have granted bargained and sold and by these presents do grant bargain an sell unto Robt Lemmon Jr one of the parties aforesaid Four hundred Cords of wood now Cut and lying on the Land of Charles R. Duvall near the Furnaces belonging to the said Robt Lemmon Junr & Co To Have and To Hold the said wood to the said Robt Lemmon Jr his administrators Executors and assigns forever In trust always that so long as I the said Henry Myers shall continue to coal the said wood and to haul the coal made therefrom to the Patuxent Furnaces the said Robt Lemmon Jr Shall leave me in quiet possession of the said Wood But that whenever either of my own accord or from any other cause whatsoever I shall cease so to do then the said Robt Lemmon Jr shall take possession of the said wood and disposeing of it as shall seem to him best for the interest of all concerned apply the proceeds thereof first to the payment of my indebtedness to the firm of Robt Lemmon Junr & Co and paying the balance if any there be to me the said Henry Myers In Witness whereof this 17th day of May 1850 hereunto affix my hand seal Witness Henry Myers (seal) John Spears State of Maryland A A County Sct Be it remembered that on this 17th day of May 1850 before me the subscriber a Justice of the peace of the State of Maryland in and for the County of Anne Arundel personally appeared Henry Myers party grantor to the above Indenture and acknowledged the said Indenture to be his act and deed for the purposes therein named at the same time personally appeared Robt Lemmon Junr and made oath on the Holy evangely of Almighty God that the above Indenture of Mortgage is made fairly and Bona fide and that the consideration for the same is true as therein Expressed James Spears Anne Arundel County To wit I certify that Robert Lemmon & Co has paid one dollar being the Stamp Duty on this Instrument under the act of 1846 chapter 61 Given under my hand this 1st day of June 1850 Jos H Nicholson Clk Recorded on the 1st day of June 1850 Co 62½ Paid |
