361 state of Maryland a Justice of the peace for Anne Arundel County personally appeared Passmore McCullough party grantor in the annexed instrument of writing and acknowledges the same to be his act and deed And I do further certify that I know of my own knowledge the person who has signed and acknowledged the said deed or instrument of writing to be the same mentioned and named in said deed or instrument of writing as party grantor Acknowledged before & certified by Edward Dubois Anne Arundel County to wit: On this fourteenth day of August in the year of our Lord one thousand eight hundred and forty nine personally appeared before me the subscriber a Justice of the peace in and for the County aforesaid and Steven Gambrill party grantee to the foregoing mortgage and at the time of taking the acknowledgment of the said Passmore McCullough thereto and made oath in due form of law that the consideration set forth in the preceeding Mortgage is true and bona fide as therein set forth Sworn to before Edward Dubois Recorded on the 14.th day of August 1849 Cost $1.25
according to law and for the better securing the payments thereof and also in consideration of one dollar to me in hand at or before the sealing and delivery of these presents the receipt whereof I the said Daniel Duvall do hereby acknowledge have granted bargained and sold and by these presents do grant bargain and sell unto the said William W. Cooksey his executors administrators and assigns one negro woman named Nelly and her four children John Sally George and Jane and now in my possession To Have and to Hold the said negro woman and Nelly and her four children John Sally George and Jane to the said William W. Cooksey his executors administrators and assigns against me the said Daniel Duvall my executors and administrators and against all and every person and persons whomsoever Provided nevertheless that if I the said Daniel Duvall shall pay and satisfy to the said William W. Cooksey or to his executors administrators or assigns one third of the sum of two hundred and seventy five dollars current money on the third day of May eighteen hundred and fifty one third on the third of May eighteen hundred and fifty one and this residue with interest on the whole sum on the third of of May eighteen hundred and fifty two then this Bill of Sale and every matter and thing therein expressed shall be void and of none effect it being the true intent and meaning thereof that the said negro woman Nelly and her four children John Sally George and Jane are mortgaged by me the said Daniel Duvall to secure the said William W. Cooksey the payment of the money aforesaid In Witness whereof I the said Daniel Duvall have hereunto set my hand and affixed my seal this 14th day of Aug.t eighteen hundred and forty nine Daniel Duvall (seal) |
