357 the second part to these presents at or before the sealing and delivery hereof the receipt whereof is hereby acknowledged the said Allen Bowie Howard hath bargained and sold assigned transferred and set over released conveyed and confirmed and by these presents doth bargain and sell assign transfer and set over release convey and confirm unto the said Thomas C. B. Howard Trustee his executors administrators and assigns the following described property choses in action chattels and effects one promissory note dated the twenty second day of August in the year eighteen hundred and forty eight made by Joseph Howard payable on demand to A. B. Howard or his order for four hundred and fifty dollars with interest from the date thereof for value received one negro woman (black) aged about thirty two years and named Dinah one negro girl (black) aged about twelve years named Eliza one black mare aged about six years one curled maple low post bedstead one mahogany wardrobe together with all the silver plate and plated ware and all and singular the rest of the household and kitchen furniture of every description and kind whatsoever belonging to the said Allen Bowie Howard and being in the dwelling house and at the premises occupied by him called Mulberry Hill and situate on South river in the County of Anne Arundel and state of Maryland aforesaid and all the estate right title interest property claim and demand whatsoever both at law and in equity of him the said Allen Bowie Howard therein thereto or thereunto. To Have and to Hold all and singular the said property above described and hereby mentioned and intended to be bargained and sold assigns and conveyed with the right and advantages thereunto belonging or in anywise appertaining unto the said Thomas A. B. Howard his executors administrators and assigns. In Trust and epecial confidence nevertheless and to and for the uses and to the ends intents and purposes and under and subject to the powers and limitations hereinafter mentioned and declared of and concerning the same and to for and upon no other use trust intent or purpose whatsoever that is to say In Trust for the sole and seperate use benefit and behoof of the said Anna Maria Howard wife of the said Allen Bowie Howard so that she or any person whom she may appoint and authorise be suffered and permitted to have hold and occupy possess and enjoy the property hereby bargained and sold assigned and conveyed or intended so to be and the same be her own seperate use and benefit her coverture notwithstanding so that neither the said property nor any part thereof now the interest increase issues or profits of the same shall in any manner be liable or subject to the control power or disposal of her present or any future husband or in anywise answerable for the payment of his or their debts or bound for the fulfilment of his or their contracts or engagements and so that the said property may be sold assigned and disposed of absolutely by the said Anna Maria Howard in such manner as she may think proper and direct without the concurrence of her present or any future husband And from and immediately after the decrease of the said Anna Maria Howard then as to the whole of the said property hereby assigned and conveyed or such part or parts thereof as may remain |
