And if no grand children be living at the death of the said Elenora and the death of the said Lucy Mitchell then for the use and benefit of the brothers and sisters of the said Elenora Thompson share and share alike and to and for no other use intent or purpose whatsoever In Testimony whereof the said Henry J. Thompson and Elenora Thompson his wife and Lucy Mitchell have subscribed their names and affixed their seals on the day and year first within written Henry J Thompson (seal) Signed sealed and delivered in Elenora Thompson (seal) the presence of Gassaway Winterson Lucy Mitchell (seal) State of Maryland Anne Arundel County sct. Be it remembered that on this 25 day of July in the year eighteen hundred and forty nine before the subscriber a Justice of the peace of the state of Maryland in and for Anne Arundel County personally appears Henry J. Thompson and Elenora Thompson his wife and Lucy Mitchell all known to us as the parties named in the aforegoing deed or instrument of writing and severally acknowledged the same to be their acts and deeds according to the true intent and meaning thereof and the acts of assembly in such cases made and provided and the said Elenora Thompson being by me privately examined out of the presence and hearing of her said husband whether she doth freely and willingly execute and acknowledge the same without being induced thereto by fear or threats of or ill usage by her husband or by fear of his displeasure declares and says that she does the same willingly and freely and without being induced thereto by fear or threats of or ill usage by her said husband or by fear of his displeasure In Testimony whereof I hereunto subscribe my name on the day and year first above written Acknowledged before Gassaway Winterson Recorded on the 4.th day of August 1849 Cost $1.45
whereas the said party of the first part did by his marriage with his wife Anna Maria Howard acquire certain slaves money and other personal chattels of the seperate property and estate of his said wife before her marriage and whereas the said party of the first part is desirous of settling and securing that portion of the same or the enjoyment of his said wife and her children Now therefore this Indenture witnesseth that for and in consideration of the premises and the sum of five dollars lawful money of the United States to the party hereto of the first part in hand paid by the party of |
