of Anne (stamp) County in the said state of the other part whereas the said Samuel Day owes and stands justly indebted to the said Richard Crisp in the sum of three hundred dollars current money and to secure the payment thereof is willing to execute these presents. Now this Indenture witnesseth that the said Samuel Day for and in consideration of the premises and of the sum of five dollars current money to him in hand paid by the said Richard Crisp at and before the sealing and delivery of these presents the receipt which is hereby acknowledged hath granted bargained and sold and by these presents doth grant bargain and sell unto the said Richard Crisp his executors administrators and assigns one negro man Jake for life To Have and to Hold all and singular the said slave above bargained and sold unto the said Richard Crisp his executors administrators and assigns to his and their own use and behoof Provided always and it is declared to be the true intent and meaning of these presents that if the said Samuel Day do and shall well and truly pay or cause to be paid unto the said Richard Crisp his executors administrators or assigns the full sum of three hundred dollars current money with legal interest for the same on or before the twenty fourth day of Agust eighteen hundred and fifty then in such case these presents and every matter and thing herein contained shall cease determine and be utterly void to all intents and purposes Acknowledged before Samuel Day (seal) T. W. Stinchcomb J. P. Anne Arundel County to wit On this 24th day of February 1849 before me the subscriber a Justice of the peace in and for the said County personally appeared Samuel Day Mortgagor and made oath on the Holy Evangely of Almighty God that he gave the within mortgage for the purposes therein mentioned also at the same time and place appeared Richard Crisp mortgagee and made oath on the Holy Evangely of Almighty God that he received the within mortgage for the purposes therein mentioned Sworn before T. W. Stinchcomb (seal) Received one dollar for stamp duty on this instrument Cost 62½ paid
and forty nine and recorded in Land record Books of Anne arundel County Court one |
