318 Hanson aged about fifty five years one man named Harry aged about forty five, one man Dary Young fifty years of age one woman Liz and three children aged about thirty years one woman Deby aged about twenty years one man David aged about twenty years one boy Jerry aged thirteen years one boy John Wesley aged six years also the following stock three horses two mules three yoke of oxen three milch cows five yearling thirty sheep twenty hogs and all the farming utensils and implements now in the use and possession of the said Charles F. Worthington. To Have and to Hold all and singular the said negro slaves stock cattle and farming utensils unto the said Brice J Worthington his executors administrators and assigns to his and their own use and behoof. Provided Always and it is declared to be the true intent and meaning of these presents that if the said Charles F. Worthington his executors or administrators do and shall well and truly pay the said sum of twelve hundred dollars and forty nine dollars and sixty three cents for which the judgment aforesaid is confessed with interest as above mentioned on the day of payment therein mentioned and also the sum of five hundred and twenty five dollars part of the said note for which the said Charles F. Worthington is liable as the principal debtor at the time at which the same is payable and in full discharge of the said Judgment and from all suits charges payments executions and costs by reason of the same and likewise from all actions charges costs and damages on account of said note to the extent of the said Charles F Worthington's liability on the same and shall and do at all times well and sufficiently save harmless and keep indemnified the said Brice J. Worthington his heirs executors and administrators and every of them then and in such case these presents and every matter and thing therein contained shall cease determine and be utterly void to all intents and purposes anything herein contained to the contrary notwithstanding In Testimony whereof the said Charles F. Worthington hath hereunto set his hand and fixed his seal the day and year first above written Chas. F. Worthington (seal) In presence of J W Hunter State of Maryland Anne Arundel County to wit Be it remembered and it is hereby certified that on this twenty second day of January eighteen hundred and forty nine before me the subscriber a Justice of the peace of the state of Maryland in and for Anne Arundel County personally appeared Charles F. Worthington he being known to me to be the person named and described as and professing to be the party grantor in the foregoing Indenture and acknowledged the same to be his act and deed. In Testimony whereof I hereunto subscribe my name on the day and year aforesaid J W Hunter State of Maryland Anne Arundel County to wit: On this twenty second day of January eighteen hundred and forty nine before me a Justice of the peace of the state and County aforesaid personally appeared Brice J Worthington he being known to me to be the party grantee in the within deed of Mortgage and made oath that the consideration of the said Mortgage is true and bona fide as therein set forth sworn to before J W Hunter Received January 22 1849 one dollar for stamp duty on this Instrument Jos.
