95 money and to secure the payment thereof is willing to Execute these presents Now this Indenture witnesseth that the said Lewis D Jones for and in consideration of the premises and of the Sum of one dollar Current Money to him in hand paid by the said Dennis Claude Junior at and before the sealing and delivery of these presents the receipt of which is hereby acknowledged hath granted bargained and sold and by these presents doth grant bargain and sell unto the said Dennis Claude Junior his Executors administrators and assigns all and singular the several Negroes hereinafter particularly mentioned and expressed that is to say one negro woman named Nancy Lusco aged about twenty five years and her two Children Charles and John and also a mulatto man named Charles aged about thirty one years old: To have and To hold all and singular the said Negroes unto the said Dennis Claude Junior his Executors administrators and assigns to his and their own use and behoof Provided always and it is declared to be the true intent and meaning of these presents that if the said Lewis D Jones do and shall well and truly pay or cause to be paid unto the said Dennis Claude Junior his Executors administrators or assigns the full sum of Four hundred and forty dollars Current Money with legal interest for the same on or before the twenty fifth day of April in the year one thousand Eight hundred and Forty two then and in such Case these presents and every matter and thing herein contained shall cease determine and be utterly void to all intents in purposes anything herein Contained to the Contrary Notwithstanding And the said Lewis D Jones for himself his heirs Executors or administrators hereby Covenants and agrees to and with the said Claude that he the said Jones will well and truly pay or cause to be paid unto the said Dennis Claude Junior his Executors administrators or assigns the said Sum of Four hundred and forty dollars Current money together with interest for the same after the rate aforesaid as herein before set forth and agreed And the said Lewis D Jones his executors administrators all and singular the said Negroes by these presents granted bargained and sold and each and all of them unto the said Dennis Claude Junior his executors administrators and assigns against him the said Lewis D Jones his executors and administrators and against all and every other persona nd persons whatsoever shall and will warrant and defend by these presents In witness whereof the said Lewis D Jones has hereunto set his hand and seal the day and year first above written Signed Sealed and delivered in presence of the interlineations between the 35 and 36 Lewis D Jones (seal) lines on the first page being first made W.m Glover At the foot of the aforegoing was thus written to wit (State) |
