354 This Indenture made this ninth day of September in the year of our Lord Eighteen hundred and forty four Between Geo W Nutwell of Anne Arundel County and State of maryland of the one part and Thomas J Hall of the City of Baltimore and State aforesaid of the other part Whereas the said Thomas J Hall hath this day accepted a draft in favour of John H [illegible] by the said Geo W Nutwell payable in nine months from the date thereof for the sum of five hundred dollars And whereas it is the wish of the said Geo W Nutwell to indemnify the said Thomas J Hall for his acceptance as aforesaid and for that purpose hath agreed to Execute these presents Now this Indenture Witnesseth that the said Geo W Nutwell for and in consideration of the premises and for and in consideration of the sum of five dollars Current money to him in hand paid by the said Thomas J Hall at or before the sealing and delivering of these the receipt whereof the said Geo W Nutwell doth hereby acknowledge and thereof and therefrom doth acquit release Exonerate and for ever discharge the said Thomas J Hall his Executors administrators and assigns and every of them by these presents hath granted bargained and sold and by these presents doth grant bargain and sell unto the said Thomas J Hall his Executors administrators and assigns all and singular the following property vizt One Negro man named Henry aged twenty two years one negro man Ben aged forty years and one negro woman named May aged seventeen years and one negro woman named Matilda aged seventeen years and one Crop of Tobacco now in the field and on the land supposed to be twenty thousand pounds To have and To hold all and singular the said property herein before granted bargained and sold or mentioned or intended so to be unto the said Thomas J Hall his Executors administrators and assigns the negroes as slaves for life to the duly proper use and behoof of the said Thomas J Hall his Executors and administrators and assigns forever Provided always and these presents are upon this Condition that if the said Geo W Nutwell his Executors or administrators shall and do well and truly pay and satisfy the aforesaid accepted draft now indemnify and save harmless the said Thomas J Hall for his acceptance as aforesaid then and in such these presents and every other matter and thing therein Contained shall cease determine and be utterly void to all intents and purposes every thing herein mentioned to the Contrary thereof any wise notwithstanding and the said Geo W Nutwell for himself his Executors and administrators all and singular the said slaves and Tobacco herein mentioned by these presents granted bargained and sold and every part thereof unto the said Thomas J Hall his Executors administrators and assigns against him the said Geo W Nutwell his Executors administrators and assigns all and every other person or persons whatsoever shall and will warrant and for ever defend by these presents In (Witness) |
