295 Now this Indenture Witnesseth that the said James Lewis Duvall for and in consideration of the premises and of the sum of five dollars Current money to him in hand paid by the said Samuel Augustus Clagett and Charles Clagett at and before the sealing and delivering of these presents hath granted bargained and sold and by these presents doth grant bargain and sell unto the said Samuel Augustus Clagett and Charles Clagett their Executors administrators and assigns all and singular the goods and personal property hereinafter particularly mentioned and expressed that is to say one bay horse one black mare one sorrell Colt one pied Cow, one brindle heifer one red heifer one wagon and Gear one Cart and gear and all other the farming implements of what kind soever of him the said James Lewis Duvall together with all the Crop of oats, Corn and Tobacco now upon the farm recently purchased by him the said James Lewis Duvall of the said Samuel Augustus Clagett and Charles Clagett To have and To hold all and singular the said goods and personal property unto the said Samuel Augustus Clagett and Charles Clagett their Executors administrators and assigns to their and their own use and behoof Provided always and it is declared to be the true intent and meaning of these presents that if the said James Lewis Duvall do and shall well and truly pay or cause to be paid unto the said Samuel Augustus Clagett and Charles Clagett their Executors administrators or assigns the said sum of three hundred dollars with the interest that hath or shall accrue thereon on or before the second day of November Eighteen hundred and forty four then and in such case these presents and every matter and thing herein contained shall cease determine and be utterly void to all intents and purposes any thing herein contained to the Contrary notwithstanding In Witness whereof the said James Lewis Duvall has hereunto set his hand and affixed his seal the day and year first above written Signed Sealed and delivered in the James L Duvall (seal) presence of Wm Glover At the foot of the aforegoing was thus written to wit State of maryland Anne Arundel County Ss Be it remembered and it is hereby certified that on this second day of November Eighteen hundred and forty three before the subscriber a Justice of the peace of the said State in and for the County aforesaid personally appears James Lewis Duvall he being known to me to be the person who is named and described and professing to be the party to the foregoing deed or Indenture and doth acknowledge the same to be his act and deed In Testimony whereof I hereunto subscribe my name on the day and year aforesaid chd Wm Glover 78 6 Recorded the 20 day of November 1843 |
