28 he Executed the above Instrument of writing for the uses & purposes therein mentioned Gabriel H Duvall State of Maryland Baltimore County Sc I hereby Certify that John W Peale Gentleman before whom the within acknowledgment was made & who has thereto signed his name was at the time of so doing a Justice of the Peace of the State of Maryland and for the City of Baltimore duly Commissioned & Sworn In Testimony whereof I hereto set my hand and affix (Seal) the seal of Baltimore County Court this 18th day of February 1839 Tho.s Kell Clk Ex.d .d .d Paid .68cts 5½ Recorded the 25th day of March 1839 This Indenture made this twenty sixth day of March in the year of our Lord one thousand Eight hundred and thirty nine between Joseph Chaney of Anne Arundel County in the State of Maryland of the one part and James Chaney of the County and State aforesaid of the other part whereas the abovenamed Joseph Chaney owes and stands justly indebted to the said James Chaney in the sum of one thousand dollars Current money with Interest thereon from the date of these presents and for the purpose of securing the payment of the same the said Joseph Chaney hath agreed and is willing to Execute these presents Now this Indenture witnesseth that the said Joseph Chaney for and in Consideration of the above recited premises and for the purpose of securing the payment to the said James Chaney of the aforesaid sum of one thousand dollars Current money with Interest thereon as aforesaid and also in Consideration of the sum of five dollars Current money by the said James Chaney to him in hand paid at or before the sealing and delivery of these presents the receipt whereof the said Joseph Chaney doth hereby acknowledge hath given granted bargained sold aliened released and Confirmed and by these presents doth give grant bargain sell alien release and Confirm unto the said James Chaney his Executors administrators and assigns for ever one negro boy named William one negro boy named George one negro boy named Nace and one negro boy named Jack which negroes are now in the possession of the said Joseph Chaney To have and To hold the above named negro boys unto him the said James Chaney his Executors administrators and assigns forever Provided nevertheless and this Indenture is declared to be upon this Condition that if the said Joseph (Chaney) |
