25 chd Acknowledged before Jn.o L Moore 53 4 Recorded the 9th day of March 1839 This Indenture made this twelfth day of march in the year one thousand Eight hundred and thirty nine between James B Smith of Anne Arundel County and state of maryland of the one part and Daniel Hart and George E Franklin of the County and state aforesaid of the other part Whereas the said James B Smith owes and stands Justly indebted to the said Daniel Hart and George E Franklin in the sum of Three hundred and ninety two dollars and twenty five Cents Current money and to secure the payment thereof is willing to Execute these presents Now this Indenture Witnesseth that the said James B Smith for and in Consideration of the premises and for and in Consideration of the sum of one dollar Current money to him in hand paid by the said Daniel Hart and George E Franklin at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained and sold and by these presents doth grant bargain and sell unto the said Daniel Hart and George E Franklin their Executors administrators and assigns the following Negro Slaves to wit Ned Jenny and Caroline To have and To hold the said Negro Slaves herein before granted bargained and sold or mentioned or intended so to be unto the said Daniel Hart and George E Franklin their Executors administrators and assigns to the only proper use and behoof of the said Daniel Hart and George E Franklin their Executors administrators and assigns to the only proper use and behoof of the said Daniel Hart and George E Franklin their Executors administrators and assigns for ever provided always and these presents are upon this Condition that if the said James B Smith his Executors administrators or assigns shall and do well and truly pay or Cause to be paid unto the said Daniel Hart and George E Franklin their Executors administrators and assigns the full sum of three hundred and ninety two dollars and twenty five Cents Current money with legal interest for the same on or before the first day of march in the year Eighteen hundred and forty one then and in such Case these presents and every matter and thing therein Contained shall cease determine and be utterly void to all intents and purposes any thing herein contained to the Contrary thereof in any wise notwithstanding Signed Sealed and delivered in the James B Smith (seal) presence of Gabriel H Duvall At the foot of the aforegoing was thus written to wit |
