214 hundred and forty two before me a Justice of the peace in and for said County personally appears Benjamin E Gantt and acknowledged the foregoing instrument of writing to be his act and deed S Gambrill chd 55cts 4¼ Recorded the 16th day of November 1842 This Indenture made this fifth day of November in the year of our Lord Eighteen hundred and forty two between Benjamin E Gantt of the state of maryland and Anne Arundel County of the one part and Owen Cecil of said State and County of the other part Whereas the said Benjamin E Gantt owes to the said Owen Cecil two Judgments recovered in the County Court of the County aforesaid by the said Cecil against the said Gantt amounting principal interest and Cost up to the third day of December Eighteen hundred and forty two to about the sum of six hundred and six dollars and whereas the said Gantt hath agreed to execute these presents in order to secure the payment of the said Judgment Now the Indenture witnesseth that the said Benjamin E Gantt for and in consideration of the premises and for and in consideration of the sum of five dollars the receipt whereof is hereby acknowledged hath granted bargained and sold and by these presents doth grant bargain and sell unto the said Owen Cecil his administrators executors or assigns the following property now in possession of the said Gantt namely three mahogany dining tables two mahogany card tables one mahogany side board one large mahogany desk and bureau one dozen and a half chairs one mahogany bureau two carpets three feather beds bedsteads and bedding and all other the household and kitchen furniture not enumerated being now on the premises and in the possession of the said Gantt To have and To hold all and Singular the furniture and property unto the said Owen Cecil his executors administrators and assigns for ever provided always and these presents are upon the condition that if the said Benjamin E Gantt his executors or administrators do and well and truly shall pay unto the said Owen Cecil his executors administrators or assigns the aforesaid Judgments interest and Cost on or before the third day of December Eighteen hundred and forty two then and in such case these presents and every matter and thing therein contained shall be void to all intents and purposes and the said Benjamin E Gantt for himself his executors administrators all and singular the property herein by these presents granted bargained and sold and every part thereof unto the said Owen Cecil his executors administrators and assigns against him the said Gantt his Executors and administrators and against all and every other person or persons whatever shall and will warrant and for ever defend by these presents In Testimony whereof the said Benjamin E Gantt hath hereunto set his hand and affixed his seal the day and year first herein mentioned (Signed) |
