197 myself my heirs Executors and administrators the aforesaid Tobacco Crop to the said Nicholas Owens his Executors administrators or assigns and against me the said William Drury my Executors and administrators and against all and every person and persons whomsoever shall and will warrant and forever defend by these presents Provided nevertheless that in Case I the said William Drury of Hen shall pay and satisfy to the said Nicholas Owens or his executors administrators or assigns the sum of Four hundred & Thirty Six Dollars and seventy five Cents Current money with Interest due on the same on or before the 1st day of Octr 1843 next ensuing the present year then this bill of sale and every matter and thing therein expressed shall be void and of none effect It being the true Intent and meaning thereof that the said property is mortgaged by me the said Wm Drury to the said Nicholas Owens for the payment of the money as aforesaid as a collateral security on the same In Witness whereof I the said William Drury have hereunto set my hand and affixed my seal this 18th day of September 1842 Signed Sealed and delivered in the presence of William Drury of H (seal) Lewis Sutton S.r W Whittington At the foot of the aforegoing was thus written to wit State of Maryland Anne Arundel County to wit On this 18th day of Sept.r in the year of our Lord 1842 before me one of the Justices of the peace in and for the state and County aforesaid Came William Drury and acknowledged the above or foregoing Instrument of writing to be his act and deed And the property therein named to be the right and Estate of the above named Nicholas Owes upon the Condition as aforesaid agreeably to the act of assembly in such cases made and provided As Witness my hand the day and date aforesaid Ex.d Acknowledged before Lewis Sutton S.r chd 42½ Recorded the 21st day of September 1842 Know all men by these presents that I Samuel Norman of Anne Arundel County in the State of Maryland for and in consideration of the sum of three hundred dollars Current Money to me in hand paid by Henry C Drury of Anne Arundel County in the said state at and before the sealing and delivering of these presents the receipt whereof I the said Samuel Norman hereby acknowledge have granted bargained and sold and by these presents do grant bargain & sell unto the said Henry C Drury of W.m his executors administrators and assigns all the crop of Indian Corn now growing on my land one yoke of work [illegible] about 4 years old and the Crop of tobacco now growing on my hand To have and To hold all and singular the said stock and produce and other the premises above bargained and sold or mentioned and intended so to be to the said Henry C Drury of Wm his Executors administrators and assigns forever and I the said Samuel Norman for myself my executors my heirs and administrators all and singular (the) |
