172 Company of the Farmers Bank of maryland as endorsers for the said Richard R Goodwin for divers sums of money on sundry notes drawn by the said Richard R Goodwin and negotiated at The Farmers Bank of maryland which said notes it is intended shall be renewed from time to time It is therefore hereby declared to be the meaning of these presents and of the parties thereto that the said negro slaves hereby bargained and sold or intended to be bargained and sold to the said William Goodman Junior in manner aforesaid are to be held deemed and taken in trust and confidence in the first place to raise by a sale of the said negro slaves in such manner as the said Daniel T Hyde Dennis Claude Philip Clayton David S Caldwell James Allison & George McNeir or a majority of them or the survivor or survivors of them shall think proper and in writing direct so much money as will be sufficient therefor and the same money when raised to apply to the purpose of paying off satisfying and discharging all and Singular the said debts together with all interest and costs that may accrue thereon and in all respects to save harmless and indemnify the said Daniel T Hyde Dennis Claude Philip Clayton David S Caldwell James Allison and George McNeir their heirs executors administrators for and on account of their having become bound as aforesaid is for any monies that they may hereafter be compelled to advance for and on account of him the said Richard R Goodwin and whereas the said Richard R Goodwin owes and stands Justly indebted unto a certain William Goodman Sen.r in the sum of one hundred and fifty dollars upon three several notes dated the sixteenth day of march in the year Eighteen hundred and forty one each for the sum of fifty dollars now it is hereby declared that this Indenture is upon the trust and confidence in the second place that the said William Goodman Junior shall apply any surplus which may remain of said sales after satisfying the aforesaid liabilities of the said Daniel T Hyde Dennis Claude Philip Clayton David S Caldwell James Allison and George McNeir above mentioned to the payment and satisfaction of said debt due to the said William Goodman Sen.r and all interest and Costs which may accrue thereon In Testimony whereof the said Richard R Goodwin hath hereunto set his hand and affixed his seal the day and year first herein before written Signed sealed & delivered presence of Richd R Goodwin (seal) Wm Glover At the foot of the aforegoing was thus written to wit State of Maryland Anne Arundel County to wit On this fifteenth day of April in the year 1842 personally appeared Richard R Goodwin before me the Subscriber a Justice of the peace in and for Anne Arundel County aforesaid and acknowledged |
