Benjamin Harwood deceased in five several obligations each dated on
the Twenty Eith day of December in the year Eighteen hundred and thirty
Eight for the sum of fifteen hundred and twenty Eight dollars and ten Cents
with Interest thereon from the fifteenth day of December in the year
Eighteen hundred and thirty Eight and payable severally in one two
three four and five years from the said last mentioned date  Now know
all men by these presents that I the said Francis Brashears for the purpose
of saving the said Charles Clegett and Allen Marriott harmless from
the said obligations and in consideration of the sum of one dollar Current
money by them to me in hand paid at or before the sealing and delivery of these
presents the receipt whereof is hereby acknowledged have granted bargained
and sold and by these presents do grant bargain and sell unto the said
Charles Clegett and Allen Marriott their Executors administrators and
Assigns the following Negroes now owned and held by me that is to say
one negro man named Andrew and aged about thirty four years one negro
boy names Simon and aged about nineteen years one negro boy Anthony
aged about twelve years one negro boy named Daniel and aged about
Eight years one negro boy named Tom and aged about eight years one negro
boy named Jacob and aged about six years one negro boy named Dick
and aged about Eighteen months one negro woman Maria and
aged about thirty three years one negro woman named Jenny and
aged about thirty years one negro girl named Mary and aged about
sixteen years one negro girl named Rebecca aged about twelve years
one negro girl named Rachel aged about Eight years one negro girl
named Jane and aged about three years  To have and To hold the
aforesaid negroes with their increase unto and to the use of the said
Charles Clegett and Allen Marriott their Executors administrators
and assigns provided nevertheless that if I the said Francis Brashears
my Executors or administrators shall well and truly discharge and
satisfy the sums of money secured by the aforesaid Bonds with interest
thereon at or before the days limitted for the payment thereof respectively
and shall in all other respects save the said Charles Clegett and
Allen Marriott harmless from all loss and charge by reason of their
suretyship for me as aforesaid then these presents and every thing
herein contained shall be utterly null and void and it is further
understood that until default shall be made in payment of the
aforesaid sums of money and interest or some part thereof the aforesaid
negroes shall remain in my possession to be used and employed by me
