178 William D. and John W. D. Mackey which bond is for the sum ten thousand dollars on which bond the said Pierce and Warfield are sureties in consideration thereof and of the sum of five dollars in hand paid at and before the sealing and delivery of these presents the receipt of which I do hereby acknowledge I do hereby bargain and sell to the said Myers Pierce and seth W. Warfield all my crops of corn and wheat now growing on the farm in Howard county called "Waveland" and also all my right title and interest in Negro slaves Julia Isabella and her two children Levi, Jane and her two children and in the proceeds of the sale of negro Jerry ordered to be invested by the orphans court of Howard county (the said negroes having been the property of my late wife) provided that if the said Alexander L. Mackey shall discharge all sums due by him as guardian of the said children above named and shall relieve the said Pierce and Warfield and their representatives from all legal liability as sureties on the said guardians bond and shall repay to the said Pierce and Warfield all sums that they or either of them shall at any time pay on account of their liability as such sureties then these presents to be void but it is expressly stipulated that the said Pierce and Warfield and their representatives shall have power to take possession of said crop of corn and wheat at the time of the maturity of each and to sell and dispose of the same for their indemnity unless the same are previously redeemed by me and the conveyance of the above named negroes is made subject to the Mortgage rights of Mrs Mary Anne Dorsey Witness my hand and seal this third day of June Eighteen hundred and fifty six signed sealed and delivered in presence of the words A.
