any capital projects having a proposed programmatic change which
will result in an increase of:

(1)  7.5% or more of the project cost estimate approved by the
General Assembly at the time funds for that project were
approved, and/or

(2) 5% or more of the gross square footage approved by the
General Assembly at the time funds for that project were
approved.

No increase in excess of 7.5% of a total project's cost or 5% of a
total project's gross square footage may be approved or
implemented prior to review and comment by the budget
committees, or the passage of 45 days from the receipt of the
quarterly report containing the proposed modification(s).

(A) Department of Public Safety and Correctional Services. Provide a
fund to acquire property, design, construct and equip capital
improvements for the Department of Public Safety and
Correctional Services. Expenditures for any of the following
projects may not exceed the amount listed below for that project by
more than 7.5% without notification to the General Assembly.
Expenditure of any part of this appropriation for a project not
listed below shall also require notification to the General

35.02.00                               DIVISION OF CORRECTION

Headquarters:

Acquire Land For A New 720 cell Medium/Minimum Security
Facility (site to be determined), provided that no funds may be
expended until the Department of Public Safety and Correctional
Services has submitted an approved program plan for the new 720
cell prison, including a phasing plan, a General Services cost
estimate and an aggregate appraised property value for the 180
acres comprising the Celanese Corporation site in Allegany County
which the department intends to purchase and use for the purpose
of constructing the new medium/minimum security facility, and the
budget committees have reviewed and commented upon the
program plan, or 45 days have elapsed from the date the program
is received by the committees.

Further provided that it is the intent of the General Assembly
that the Department of Public Safety and Correctional Services
should negotiate land purchase contracts to avoid the payment
of relocation costs for existing businesses at the Celanese
Corporation site.
