September 1857 a Certain Thomas W. Byns did recover against a Certain Levin W. Tall as well the
sum of one hundred dollars debt and the sum of two hundred dollars ^for his^ damages which he had sustained
by occasion of the non performance of a Certain promise and assumption to the said Thomas W. Byns
before that time made as the sum of ten dollars and thirty three Cents for his Costs and Charges by
him about his suit in that behalf Expended whereof the said Levin W. Tall is Convict as of record
is manifest  And whereas at a Superior Court for Baltimore City held at Baltimore on the first day
of May 1852 it was Considered that the said Thomas W. Byns should have his Execution against the
said Levin W. Tall as well for the debt & damages as for the Costs aforesaid the Sheriff of Dorchester
County was therefore Commanded that of the goods and Chattels lands & tenements of the said Levin
W. Tall being in his bailiwick he should Cause to be made & levied the aforesaid debt damages
Costs and Charges & that he should have those sums of money before the Circuit Court for Dorchester
County on the fourth Tuesday of July 1852 to render unto the said Thomas W. Byns and that the
Sheriff should also have then & there that writ and whereas also the said writ Came unto the hands
of the said Sheriff and in pursuance of the Command therein he laid the same upon two negroes
viz:  John & Sarah among other property and whereas the said Sheriff afterwards returned to the said
Court his action in the premises and the levy by him made & that said property remained in his Custody
on hand so that he Could not have those sums before the Court as Commanded and whereas also on the
the twenty third day of August in the year Eighteen hundred and fifty two a Certain other writ of the
State of Maryland of venditioni Exponas did issue forth out of the Circuit Court for Dorchester County
to the said Sheriff of Dorchester County directed reciting the premises as hereinbefore set forth
whereby the said Sheriff was Commanded that the said negroes John & Sarah among other property
be expose to Sale and the money therefrom arising he should have before the Said Court on the third
tuesday of October then next to render unto the said Thomas W. Byns the debt damages Costs and
Charges aforesaid and all Such Costs as had accrued on the writ of fieri facias aforesaid & that he
should have then & there that writ &c and whereas also the said last mentioned writ Came to the
hands of said Sheriff and in pursuance of the Command therein the said Sheriff after due notice
being given did on the twenty third day of October in the year eighteen hundred and fifty two Expose
to public Sale to the highest bidder the said negroes John and Sarah and the herein before named
Thomas W. Byns became the highest bidder and purchaser of the Said negroes for the sum of one
hundred and Eighty three dollars and Seventy eight Cents Current money & hath paid since the
said purchase money & is now desirous of obtaining a title to said negroes in Consequence thereof now
this Indenture witnesseth that for and in Consideration of the premises and of the sum of five
dollars to the said Sheriff in hand paid at & before the sealing & delivery of these presents the receipt
whereof is hereby acknowledged the said James E. Douglass Sheriff as aforesaid hath granted
bargained and sold & by these presents doth grant bargain & sell unto the said Thomas W. Byns his
heirs and assigns the said negroes so aforesaid taken a writ of fieri facias & so as aforesaid sold in
virtue of said writ of venditioni Exponas   To Have & to Hold the said negroes John and Sarah
unto the Said Thomas W. Byns his heirs and assigns forever

       In witness whereof the said Sheriff James E. Douglass has hereunto set his hand & seal the day &
