(I) TO AN APPLICATION FOR A CLASS B (ON-SALE) BEER WINE AND
LIQUOR LICENSE FOR A PREMISES LOCATED IN LEONARDTOWN; OR
(II) [in] IN the event any school, church, or other place of worship
locates its building within 300 feet of any licensed premises after the licensed
premises are there established.
(c) The Board of License Commissioners may not issue or transfer an off-sale
alcoholic beverages license of any class for the use in a business that is intended to be
operated as a drive-through purchase facility where alcoholic beverages are to be sold
at retail and dispensed through a window or door to a purchaser in or on a motor
vehicle for off-premises consumption.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
June 1, 2004.

AN ACT concerning
Crimes - Substance Abuse - Parole - Civil Commitment - Diversion
FOR the purpose of requiring the Parole Commission to consider certain reports
relating to drug and alcohol use when considering suitability for parole under
certain circumstances; establishing parole eligibility for certain nonviolent
offenders who are ordered to undergo drug or alcohol treatment; establishing
procedures for certain criminal defendants to receive certain dispositions in
certain criminal cases under certain circumstances; authorizing a court, under
certain circumstances, to enter a certain order; establishing a certain fee;
requiring certain dispositions in criminal cases to be entered in certain State
records; making certain offenders eligible for certain treatment; altering
procedures relating to evaluation and treatment of criminal defendants for drug
and alcohol abuse under certain circumstances; requiring certain evaluations be
conducted in a certain manner; authorizing a court to order certain evaluations
under certain circumstances; authorizing a court to order certain treatment that
the Department of Health and Mental Hygiene or its local designee considers
necessary under certain circumstances; requiring that a defendant ordered to
treatment be supervised in a certain manner; providing that certain evaluation
requirements and departmental regulations for local designees of the
Department under this Act are not applicable under certain circumstances;
authorizing a court to issue a warrant for the arrest of a certain individual
under certain circumstances; establishing the Maryland Substance Abuse Fund
to be used for evaluation and treatment of criminal defendants for certain drug
or alcohol abuse problems; establishing certain procedures relating to the Fund
and money received by the Fund; requiring counties to establish a local drug and
