(4) A member removed under this subsection has the right to a de novo
review of the removal by the Circuit Court for Howard County.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 2004.

AN ACT concerning

Leonardtown - Alcoholic Beverages - Location of Premises with Class B

License

FOR the purpose of exempting applications for Class B (on-sale) beer, wine and liquor
licenses for premises in Leonardtown from the prohibition against alcoholic
beverages license applications being approved by the Board of County
Commissioners for premises in St. Mary's County within a certain distance of
certain schools or places of worship; making technical corrections; and generally
relating to the issuance of alcoholic beverages licenses in St. Mary's County.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 2B - Alcoholic Beverages

9-219.

(a)     This section applies only in St. Mary's County.

(b)     (1) [The] EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS
SUBSECTION, THE Board of License Commissioners may not approve any application
for a license to sell alcoholic beverages in any building the nearest wall of which
measured in a direct line is within 300 feet of the nearest point of the main buildings
of any public or nonpublic kindergarten, elementary or secondary school, church or
other place of worship.
