(2) Except as otherwise provided by law, and subject to § 2-103.4 of this
article, each deputy, officer, and employee of the Administration:

(i) Is in the State Personnel Management System; and

(ii) Is entitled to the salary provided in the pay plan established
under Title 8, Subtitle 1 of the State Personnel and Pensions Article.

(e) [(1) Except as provided in paragraph (2) of this subsection, the] THE
Administration may delegate to the Office of Administrative Hearings the power and
authority under the Maryland Vehicle Law to conduct hearings under this article and
render [proposed findings of fact and proposed conclusions of law.

(2) The Administration may delegate to the Office of Administrative

decisions in hearings conducted under [§§ 13-705.1, 21-1005, and 22-218, and Title
16, Subtitles 1 through 4 of] this article.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect October 1, 2004.

(Senate Bill 39)

AN ACT concerning

Public Safety and Correctional Services - Inmates Confined to State
Correctional Facilities - Release Dates

FOR the purpose of requiring a modification of a release date from confinement in a
State correctional facility when the scheduled release date falls on a certain day;
requiring the Commissioner of Correction to adopt certain regulations
establishing a release plan for inmates upon release from a facility; and
generally relating to inmate release dates.

BY repealing and reenacting, with amendments,
