(b) The Board shall include in its report findings and recommendations
regarding:

(1)     management strategies for achieving efficiencies in the operation of
Morgan State University;

(2)     strategies for managing future enrollment growth in a cost effective
manner; and

(3)     efforts to improve access and affordability through the use of
scholarship aid based on student financial need.

SECTION 9. AND BE IT FURTHER ENACTED, That, for a taxable year
beginning after December 31, 2003 but before January 1, 2005:

(a)     A corporation's estimated tax payments for the taxable year that are due on
or after July 1, 2004
shall reflect the income tax surcharge imposed under § 10-102(2)
of the Tax - General Article, as enacted by Section 2 of this Act; and.

(b)     Notwithstanding §§ 13-602 and 13-702 of the Tax - General Article, except
as provided in subsection (c) of this section and subject to §§ 13-606 and 13-714 of the
Tax - General Article,
the Comptroller shall assess interest and penalties under §§
13-602 and 13-702 of the Tax - General Article if a corporation pays estimated
income tax for the taxable year in an amount less than 90% of the tax required to be
shown on the corporation's income tax return for the taxable year.

(c)      The Comptroller may not impose interest or penalty relating to
underpayment of estimated income tax for a payment that was due before July 1, 2004,
to the extent that the interest or penalty would not have been incurred but for the
income tax surcharge imposed under § 10-102(2) of the Tax - General Article as
enacted by Section 2 of this Act.

SECTION 10. AND BE IT FURTHER ENACTED, That:

(a)     The General Assembly and Governor shall establish a commission to study
the coordination, funding, educational delivery, and State commitment to higher
education in Maryland.

(b)     The commission shall consider:

(1)     Methods to provide a combined level of State funding support and
tuition revenue to enable Maryland's public institutions of higher education to meet the
goals of the Maryland Charter for Higher Education and compete with peer
institutions across the country; and

(2)     Other issues related to State funding and tuition revenue for public
institutions of higher education.

(c)      The commission shall be composed of:

(1) Four members of the Senate of Maryland, appointed by the President
of the Senate;
