The Public Local Laws of Frederick County

Section 2-13-34

Article 11 - Public Local Laws of Maryland

(1979 Edition and April 2002 Supplement, as amended)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 11 - Frederick County

2-13-34.

(A)     THE BOARD, BY ORDINANCE, MAY ESTABLISH, CHARGE, LEVY, AND
COLLECT A FEE OR TAX FOR THE REASONABLY ANTICIPATED CAPITAL COSTS AND
OPERATING COSTS FOR THE COLLECTION AND DISPOSAL OF SOLID WASTE.

(B)     THE AUTHORITY GRANTED TO THE BOARD IN THIS SECTION APPLIES IN
ALL MUNICIPAL CORPORATIONS IN THE COUNTY.

(C)     A FEE OR TAX LEVIED UNDER THIS SECTION:

(1)      UNLESS OTHERWISE PROVIDED BY ORDINANCE, SHALL BE
COLLECTED AND SECURED IN THE SAME MANNER AS GENERAL REAL PROPERTY
TAXES; AND

(2)      IS SUBJECT TO THE SAME PENALTIES, PROCEDURE, SALE, AND LIEN
PRIORITY IN CASE OF DELINQUENCY THAT ARE PROVIDED FOR GENERAL REAL
PROPERTY TAXES.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 2004.

Dear Mr. Speaker:

In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed House Bill 878 — Cooperative Housing Corporations, Condominiums, and
Homeowners Associations - Electronic Transmission of Notices and Votes.

This bill authorizes a cooperative housing corporation, a council of unit owners of a
condominium, and a homeowners association to provide notice of a meeting or deliver
information by electronic transmission, if specified conditions are met, and provides
that the notice or delivery by electronic transmission shall be considered ineffective if
specified conditions are met.

Senate Bill 568, which was passed by the General Assembly and signed by me on May
