A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A MISDEMEANOR AND
ON CONVICTION IS SUBJECT TO IMPRISONMENT NOT EXCEEDING 1 YEAR OR A FINE
NOT EXCEEDING $1,000 OR BOTH. REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 83 and the second sentence of § 85. In subsection (b) of this section, the phrase "is guilty of a misdemeanor" is
added to state expressly that which only was implied in the former law by
reference to a "punishable" violation. In this State, any crime that was not
a felony at common law and has not been declared a felony by statute is
considered to be a misdemeanor. See State v. Canova, 278 Md. 483, 490
(1976), Bowser v. State, 136 Md. 342, 345 (1920), Dutton v. State, 123 Md.
373, 378 (1914), and Williams v. State, 4 Md. App. 342, 347 (1968). Also in subsection (b) of this section, the former phrase "in the discretion of
the court" is deleted as implicit in the establishment of maximum
penalties. Defined terms: "Flag" § 10-701
"Person" § 1-101 10-705. CONSTRUCTION OF SUBTITLE. THIS SUBTITLE SHALL BE CONSTRUED TO CARRY OUT ITS GENERAL PURPOSE
AND TO MAKE UNIFORM THE LAWS OF THE STATES THAT ENACT IT. REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 86. Defined term: "State" § 1-101 10-706. SHORT TITLE. THIS SUBTITLE MAY BE CITED AS THE MARYLAND UNIFORM FLAG LAW. REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 87. The reference to the "Maryland" Uniform Flag Law is added to reflect
changes made to this subtitle that were not reflected in the former uniform
law recommended by the National Conference of Commissioners on
Uniform State Laws. Defined term: "Flag" § 10-701
GENERAL REVISOR'S NOTE TO SUBTITLE The National Conference of Commissioners on Uniform State Laws originally
promulgated and recommended the Uniform Flag Law in 1917. It remained a
recommended uniform law until 1966, when the National Conference withdrew the
uniform law as obsolete. During its history as a uniform law, the Uniform Flag Law
was adopted by 17 states, four of which substantially modified it. Only three other
