(E) PENALTY. A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A MISDEMEANOR AND
ON CONVICTION IS SUBJECT TO A FINE NOT EXCEEDING $500. REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 82 and the first sentence of § 85. In subsections (b) and (c) of this section, the former references to a
"drawing" are deleted as included in the references to a "figure". In subsection (b) of this section, the former reference to placing any word,
etc. "in any manner" is deleted as surplusage. In subsection (c) of this section, the former reference to being "appended,
affixed or annexed" is deleted as included in the reference to being
"attached". Also in subsection (c) of this section, the former reference to "[e]xpos[ing] to
public view" is deleted as included in the reference to "exhibit[ing]".
Similarly, in subsection (d) of this section, the former reference "for
exhibition or display [e]xpos[ing] to public view" is deleted as included in
the reference to "displaying]". In subsection (d) of this section, the former reference to "any substance" is
deleted as included in the reference to "an article". Also in subsection (d) of this section, the former reference to a "thing for
holding or carrying merchandise" is deleted as included in the reference to
a "receptacle". Also in subsection (d) of this section, the former references to "call[ing]
attention to" and "distinguishing]" an article are deleted as included in the
references to "advertising]" and "mark[ing]" the merchandise. Defined terms: "Flag" § 10-701
"Person" § 1-101 10-704. MUTILATION. (A) PROHIBITED. A PERSON MAY NOT INTENTIONALLY MUTILATE, DEFACE, DESTROY, BURN,
TRAMPLE, OR USE A FLAG: (1) IN A MANNER INTENDED TO INCITE OR PRODUCE AN IMMINENT
BREACH OF THE PEACE; AND (2) UNDER CIRCUMSTANCES LIKELY TO INCITE OR PRODUCE AN
IMMINENT BREACH OF THE PEACE. (B) PENALTY.
