2002 LAWS OF MARYLAND
A PERSON WHO VIOLATES SUBSECTION (C) OF THIS SECTION IS GUILTY OF A
MISDEMEANOR AND ON CONVICTION IS SUBJECT TO IMPRISONMENT NOT
EXCEEDING 90 DAYS OR A FINE NOT EXCEEDING $500 OR BOTH. REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 156D. In subsection (b) of this section, the reference to responding to false alarms
from "a defective alarm system" is substituted for the former reference to
"answering] to false alarms" in order to clarify the circumstances in which
written notice is required. In subsection (c) of this section, the reference to using a defective alarm
system "after receiving a written notice under subsection (b) of this
section" is substituted for the former reference to "continu[ing] to use" a
defective alarm system for clarity and consistency within this section. Defined terms: "Alarm system" § 9-607
"Alarm system contractor" § 9-607
"Alarm user" § 9-607
"False alarm" § 9-607
"Law enforcement unit" § 9-607
"Person" § 1-101 9-611. AUDIBLE ALARM SYSTEM. (A) "AUDIBLE ALARM SYSTEM" DEFINED. IN THIS SECTION, "AUDIBLE ALARM SYSTEM" MEANS AN ALARM SYSTEM THAT,
WHEN ACTIVATED, EMITS AN AUDIBLE NOISE FROM AN ANNUNCIATOR (B) REQUIRED EQUIPMENT. AN AUDIBLE ALARM SYSTEM SHALL BE EQUIPPED TO: (1) AUTOMATICALLY SILENCE THE ANNUNCIATOR WITHIN 30 MINUTES
AFTER ACTIVATION; AND (2) ALLOW AN ACCIDENTAL OR NEGLIGENT ACTIVATION TO BE HALTED OR RESET. (C) PROHIBITED. AN ALARM SYSTEM CONTRACTOR MAY NOT SELL, LEASE, RENT, OR OFFER TO
SELL, LEASE, OR RENT AN AUDIBLE ALARM SYSTEM THAT DOES NOT COMPLY WITH
THE REQUIREMENTS OF THIS SECTION. (D) PENALTY. A PERSON WHO VIOLATES THIS SECTION IS SUBJECT TO A CIVIL PENALTY OF
$100 FOR EACH VIOLATION. REVISOR'S NOTE: Subsection (a) of this section is new language added for
clarity.
