In paragraph (1) of this subsection, the former reference to property
including "but not limited to" specified items is deleted as unnecessary. See
Art. 1, § 30. In paragraph (2)(v) of this subsection, the reference to "anything of value"
is deleted as unnecessary in light of paragraph (1) of this subsection. In paragraph (2)(viii) of this subsection, the former reference to "a state of"
confinement is deleted as surplusage. In item (2)(xii)1 of this subsection, a comma is added between
"merchandising" and "production" for clarity. In item (2)(xii)2 of this subsection, the phrase "designed process," is
retained, although substituting the phrase "design, process," may be more
accurate. The Criminal Law Article Review Committee calls this retention
to the attention of the General Assembly. In item (2)(xiv) of this subsection, the former reference to "other tangible or
intangible items of value" is deleted as included in the comprehensive
reference to "anything of value" in item (1) of this subsection. (I) PROPERTY OF ANOTHER "PROPERTY OF ANOTHER" MEANS PROPERTY IN WHICH A PERSON OTHER THAN
THE OFFENDER HAS AN INTEREST THAT THE OFFENDER DOES NOT HAVE THE
AUTHORITY TO DEFEAT OR IMPAIR, EVEN THOUGH THE OFFENDER ALSO MAY HAVE
AN INTEREST IN THE PROPERTY. REVISOR'S NOTE: This subsection is new language derived without
substantive change from former Art. 27, § 340(j). The former reference to "real or personal" property is deleted as
surplusage. Defined term: "Person" § 1-101 (J) SERVICE. "SERVICE" INCLUDES: (1) LABOR OR PROFESSIONAL SERVICE; (2) TELECOMMUNICATION, PUBLIC UTILITY, TOLL FACILITY, OR
TRANSPORTATION SERVICE; (3) LODGING, ENTERTAINMENT, OR RESTAURANT SERVICE; AND (4) THE USE OF COMPUTERS, DATA PROCESSING, OR OTHER
EQUIPMENT.
