In subsection (a) of this section, the former reference to "regulations" is
deleted as surplusage. Defined terms: "Person" § 1-101
"Railroad vehicle" § 6-501 6-504. GIVING A FALSE TRAIN SIGNAL. (A) PROHIBITED. A PERSON MAY NOT GIVE A TRAIN SIGNAL TO START A STOPPED TRAIN OR TO
STOP A MOVING TRAIN UNLESS THE PERSON IS AN AUTHORIZED EMPLOYEE OF A
RAILROAD COMPANY. (B) PENALTY. A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A MISDEMEANOR AND
ON CONVICTION IS SUBJECT TO IMPRISONMENT NOT EXCEEDING 6 MONTHS. REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 456. The Criminal Law Article Review Committee notes, for the consideration
of the General Assembly, that subsection (a) of this section appears to allow
an authorized employee of any railroad company to start or stop a train,
not merely the railroad company that is operating the train. Defined term: "Person" § 1-101
6-505. STRIKING RAILROAD VEHICLE WITH OBJECT. (A) "RAILROAD" DEFINED. IN THIS SECTION, "RAILROAD" HAS THE MEANING STATED IN § 1-101 OF THE
PUBLIC UTILITY COMPANIES ARTICLE. (B) PROHIBITED. A PERSON MAY NOT WILLFULLY AND MALICIOUSLY STRIKE A RAILROAD
VEHICLE ON A RAILROAD OR ON AN ELECTRIC RAILWAY IN THE STATE BY: (1) SHOOTING OR THROWING AN OBJECT AT THE RAILROAD VEHICLE; OR (2) CAUSING AN OBJECT TO FALL ON THE RAILROAD VEHICLE.
(C) PENALTY. A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A MISDEMEANOR AND
ON CONVICTION IS SUBJECT TO IMPRISONMENT NOT EXCEEDING 5 YEARS OR A FINE
NOT EXCEEDING $1,000 OR BOTH. REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 458.
