(2) An instructional permit is not a license within the meaning of the
single license restriction placed upon drivers of commercial motor vehicles.
(e) (1) In addition to the requirements contained in subsections (a), (b), and
(c) of this section, an operator must obtain State-issued endorsements of an
operator's commercial driver's license to operate commercial motor vehicles which
are:
[(1)] (I) Double/triple trailers;
[(2)] (II) Vehicles designed to transport 16 or more passengers including
the driver (passenger vehicles);
(III) SCHOOL BUSES;
[(3)] (IV) Tank vehicles; or
[(4)] (V) Required to be placarded for hazardous materials.
(2) A SCHOOL BUS ENDORSEMENT AUTHORIZED UNDER THIS
SUBSECTION IS ALSO AN ENDORSEMENT FOR VEHICLES DESIGNED TO TRANSPORT
16 OR MORE PASSENGERS INCLUDING THE DRIVER (PASSENGER VEHICLES).
16-816.
(a) An individual may not drive a school vehicle (school bus) on any highway
in this State unless the individual:
(1) Passes an appropriate medical examination; and
(2) Has FOR DRIVING A SCHOOL BUS, HAS been issued a commercial
driver's license endorsed [passenger vehicle] SCHOOL BUS.
(b) With the advice of the State Department of Education, the Administration
may adopt regulations concerning the qualifications of school vehicle drivers.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall be
construed prospectively to apply only to individuals applying for a commercial driver's
license to drive a school bus on or after the effective date of this Act.
SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take
effect October 1, 2002.
